Hi, guys:
My friend filed I-140 and I-485 concurrently on 8/6/2007. His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
how do you guys handle this prolem ? Any suggestion is appreciated.

I am currently on F1 and will be graduating in December 2007. In August filed I485/EAD/AP through spouse. Now I am planning to change my status from F1 to H4 to maintain the status till I485 is approved.
1. I want to know will my COS from F1 to H4 affect my 485 application as I haven�t received the receipt notice yet.
2. Should I apply for H4 right away or wait until I receive I485 receipt notice and EAD card?
3. How long does it take to get H4 approval?
4. How long, before I graduate should I apply for H4?
5. Is it a good idea to change to H4?

My and my family I-140 is approved. Based upon this approval I got three years H1B visa extension too. By the way this is my 13th year in the USA.
As a plan B, if I move my family to Canada, as we have Canadian residency, to continue their lives there. And in the mean time say after 1 year of their going there, say here in the USA our priority dates become current. At such a juncture will there be any way that I delay filing their I485 so they may get their Canada citizenship without creating any conflict between US and Canada residency status.

I'm currently moving back to Northern Idaho and am trying to finally get my foot in the door as a photographer. Basically I've emailed some companies asking about the need for a part/full time photographer. Of course, they are all interested in sample shots (not a problem) and rates :confused:. I don't know what to say on the rates part. I've searched through the old threads, but didn't see any. Roughly, what is a normal rate? Keep in mind It's not a huge city (pop. 32,000,not including surrounding areas).

The story of the new Congress is actually two stories. Democratic leaders and their grass-roots supporters will decide in the coming days which narrative will prevail.
In January, Democrats dominated the news, the public agenda and the Republicans. In the last weeks of February, the Republicans came back -- not by offering grand proposals but by using the limited tools they have to prove that Democrats don't have enough power, yet, to end the war in Iraq.
When they took control, Democrats looked crisp and disciplined, attributes not normally associated with their party. Speaker Nancy Pelosi's House quickly passed the Democrats' popular campaign promises, including measures on the minimum wage, stem cell research, renewable energy and reforms of the student loan and Medicare prescription drug programs.
This agenda had its skeptics, but it provided focus for a party long out of power and drew significant Republican defections, feeding a raft of "Republicans in Disarray" stories. Pelosi noted at a January news conference that so many Republicans voted for the Democratic proposals that one of her colleagues joked: "Maybe you made these bills too easy."
The Senate Democrats quickly pushed through a different version of the minimum-wage increase, and the party's leading foreign policy voices framed a critique of President Bush's Iraq policy that squared with the public's increasingly skeptical view of the war.
But recent weeks have held nothing but trouble for Democrats -- and it is odd, as one Democrat noted, that they should be on the defensive when the scandal over the treatment of wounded veterans at Walter Reed Army Medical Center has focused attention on yet another failed aspect of the administration's execution of the war and its aftermath.
Instead, one news story after another has highlighted differences among congressional Democrats over how to end the war. There is also the divide between the Washington party and activists at the grass roots and in the blogosphere. All of these problems are rooted in two unalterable facts: Democrats, on the basis of their thin majorities in Congress, lack the numbers to force an unwilling president to alter his course. And they are short of votes to cut off funds for the war altogether.
My Comments
Dems are not united on most issues.
Although this article is on Iraq, a similar situation will occur on Immigration. The big difference is that Dems are very interested in Iraq (they won elections on Iraq) whereas I haven't seen much much Democratic interest on Immigration.

Hi, I have my labor approved by Company A and I140 filed as soon as I got the labor. Before this I140 got approved I changed to Company B who filed for my labor and applied for I140 as soon as it got approved. My I140 with company B got approved and then the I140 with the old company A got approved 3 months later. Can I somehow get the old PD. Can some one who have been in similar situation or know some one in the similar situation answer this. I will be able to get a 2 year advance if this works out.

My cousin from India has a BCOM degree and he is filing for a H1 B visa.
He just heard from his lawyer 2 days ago that his credit evaluation was needed and he had to get experience letters for atleast 3 years of work ex.
He gave it to his lawyer and now they tell him that they will submit his application without the evaluation! They said that once an inquiry comes if it even does then we will submit the evaluation.
Is that ok??? or should he be submitting the evaluation with the application. I am concerned but I guess it too late now.

My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.
Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

We have been applying for advance parole document at NSC for the last few years.
This time we sent our application to NSC on 01/28/2010.
After about 15 days, we received a receipt notice letter from Vermont service center.
The I-131 application instructions specify that I-140 based applications should be sent to either Nebraska or Texas service centers.
I am wondering if USCIS started processing I-131 application in VSC.
Or our application is mistakenly misclassified and sent to VSC.
Any comments?

My I-140 was denied by TSC early last year. We sent in an MTR/Appeal on the denial. The case was sent over by the TSC to AAO. We received an RFE from the AAO on the appeal a couple of months back. We responded back to the RFE within the required time frame.
My attorney just informed me this week that the case has been transferred back to the USCIS from the AAO. Can anyone please tell me if this means that my case has been approved or denied? Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....
PLEASE HELP!!!
