You are right about members working on understanding the law in this forum and thrashing out arguments to make them fool proof. Instead I find people getting incensed at each other and creating a destructive environment instead of a constructive one.

As far as immigration lawyers go - they have no incentive to file a lawsuit to get a correct interpretation as they donot stand to gain whatever way the law is interpreted. Also while there definitely are a few smart immigration lawyers- the run of the mill ones are no better than paralegals. I'm not sure I should be saying the above but my experience points to that.

Yes. No one has bothered to go after DOS for misinterpretting the AC21 rule in allocating immigrant visa. Many people (EB2-India) raised their concern between 2003 and 2006, as DOS is not correctly following the rule and allowed the spillover to go EB3, when EB2 was in high demand particulrly from India. Even IV core did not go after DOS. As you mentioned, lawyers has no incentives. EB3 has enjoed between 2000 to 2006 (from the mercy of DOS). For example in 2006, EB2 got about 25,000 visas abot 20,000 visas (from EB2)has gone to EB3-ROW.

    Hi pat123

    The details are:

    ND: 9/17/2007

    NSC
    RD: 7/20/2007

So our NDs are very close to each other (9/17,18,19), perhaps it is pre-adjudication that is going on? Are y'all NSC as well?

Looks like they do not publish the e-mail address to contact congressman. You can send e-mail only through contact your rep system where you can send only to your local rep. If your ZIP code does not match the congressman's district, then you cannot send him the mail. Even to Judiciary committee chairman !!!!!!!!!!!
The only alternative is to send fax. I don't know how I can send so many faxes when I don't have fax at my home.
IV core: Any solution??? About 20 support messages are at stake from my side alone.

    Guys,

I got these addresses in case you want to use:. I got the list from one of the forums here. If something is not OK or the list itself, please let me know and I can change it. Else to be safe, I will send these today in the next 2-3 hrs based on responses here.
    Thanks,
    Sri.

Got a reply back just now

My mail to Capital One after getting the initial response:

    Craig,

    Thank you for the reply.

I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.

Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

Response that I received for the above email:

Thanks for your message. The information regarding Capital One's policy on pursuing EAD card holders is correct. We are only able to pursue US Citizens or Green Card holders for these roles. I'm sorry, but we won't be able to consider your candidacy at this time.

    Best Regards,

    Craig

HRs generally "quote" the policy word in every sentence they speak or write. It is a matter of interpretation. The HR may not have a decision making power and is just following what he/she is asked to do. No company has a policy that says GC or citizen, but policy can says "Authorized to work for any em ployer in the United States. I guess it is a matter of interpretation.

The HR seems to be ill informed. Many companies do accept EAD and they are quite aware of the delays in EAD renewal - and that has rarely been the basis to reject a petition.

If this is a trend then it is an issue to all, but if this is an isolated case then definitely you can look into places other than Capital One.

If you want to spend time and resources you can go to a lawyer, but you have no guarantee that you will get the job there too.

    Chanduv23:

I understand your enthusiasm of spreading +ve ness , but you need to also look at the practical implications on the situation. You are too criticizing and self-centric in what you beleive is the right thing to do.

Things do not work the way you expect at times and backfire. All I am saying is to give it a second thought if you are not getting a huge turn out of people. If you believe you are the smartest ass in the forums, tell me how many people you beleive would come forward and write a letter to the president. It's nothing to do with whether you did it, but are taking off the apprehensions and motivate other people to do it.

I agree with comments from walking_dude as it's inspiring and has a point. Get out of the shell and look at the world from a different perspective.

I am pretty straight forward in my approach and do not know how to "sugarcoat". This is not my own organization, I am not the founder of this organization, I am just a member like you. While it is individual's choice of doing what they want to do, what I have noticed is that the negative energy does have cascading effect, especially when things do not happen, those who spread negative energy seem to influence people. Once again, this is individuals own perspective. The fact that things do not happen easily we have to blow trumphets into the ears of people. Like a member said sometime back "Eagles which never flew - would not dare to fly until they are pushed, and when they are pushed forcefully and dropped into the air - they automatically start flying".

I have done what I can in the best of my capacity and continue to do so, I have considered IV as a self help group and also conducted meetings in the tri state area and continue to motivate people to make them feel a sense for the community.

If you look at IV as YOUR organization - you can see why it is important to feel a sense for the community.

The biggest issue our community faces today is the flow of negative energy. To quote examples, I was able to convince some friends for the rally in DC. Everything was going well, now when these people discussed with their collegues they were reluctant and did not show interest. The negative energy prompted my friends not to attend the rally because they felt that not many people are going for it and they tried to convince me out of IV. Such negative energy flows everywhere in the community and we have to overcome it. We can do it only by example.

Look at all those other immigration forums where people are talking bad about IV including their administrators and their owners - people who follow those websites will hate IV and hinder all our efforts. Such negative energy when it is flowing at a greater level - will cause more and more damage to our community.

It is simple - if you attack me for what I do - you are spreading negative energy - you are making a common man take a back seat and not encourage them to cooperate

If I point at h1bmajdoor's posts - I am doing it just to make sure that the positive energy flows and negativity does not influence the community.

it is a tough battle especially when you have thousands of daggers pointing at you ready to poke you.
Well, you say I am a smartass - so be it.

And if you do not support the community - stay away - why poke at someone who is doing something?

You're not getting my point! If you the merchandise is defective it is perfectly fine to return it.

Why do you guys feel the need to simply assume things and put words in someone's mouth and then go off trying to show off their opinions????

Go back to my post and read!!!!!!!!!

Well, whether a merchandise can be returned after using, depands on the nature of the merchandise and the level of customer service provided by the seller.

If you are buying a TV or a home theater, you don't know if it is functioning properly until you use it. And returning it within stipulated "return period" is not only legal but also ethical.

Some high-end sellers will even guarantee customer satisfaction by allowing a return any time, yes any time if the customer is not fully satisfied with their product. There is nothing unethical about this. That is why these high-end stores charge you a premium in the first place.

Not allowing return of merchandise reflects the low level of customer service we used to get back home. Obviously that level of service expectaion has been engrained in us so much that we believe returning used merchandise, even when the customer is not satisfied, is unethical.

What Mr. Aytes have proposed is too narrow. He is proposing that applicants whose application is pending due to Namecheck delay will not get the benefit for multi-year EAD. This is not what the current rule says. So asking for implementation of the current rule means asking for multi-year EAD for all I-485 applicants, not depending on whether or not Mr. Aytes is having a good/bad day.

There is already a standing rule since 2004-5. It is now 2008 and he has not implemented multi-year EAD rule. Given their past record, I would prefer that we not depend on their good heart for implementing this change.

One more thing, when thousands of people will write letters and something will get done, orgs like AILA and lawyers like Murthy will claim that they got it done for us :-), for our sake :-). Just wait and watch..... ;)

I think we should not mention the bellow point in the letter which we are going send to the president.

According to Mr. Aytes, USCIS is already working on it. Why to mention it in the letter?
That will rather give anti-skill-immigration crying babies one more thing to cry about.

Now what? Under the new filing fee schedule which took effect after July 29, 2007, issuance of EAD and Advance Parole for the post August 27, 2007 is "free, free, free" for the I-485 filers. Allegedly, the cost is incorporated in the I-485 filing fee of $1,020. The new regulation uses the term of "fee waiver" for EAD and Advance Parole for these I-485 filers. Now, you guessed it! Lo and Behold, the business calculation on EAD and Advance Parole has reversed. The DHS will lose a huge money by issuing single-year EAD and a separate Advance Prole document on a yearly basis over and over since they are free and they will have to keep producing it at no charge every year, which creates a huge workloads consuming its huge human resources and other production costs. This is particularly unacceptable to the agency under the predicted State Department Visa Bulletin for FY 2008 and in the future. Now, from the business standpoint, the DHS may make a huge money by issuing a multi-year EAD which will also function as a travel document. Ahah! No wonder why they are finally coming forward revealing their hidden agenda behind the new fee rule-making and EAD/Advance Parole reform business. Reportedly, Mr. Aytes of USCIS disclosed in a New York AILA conference that the USCIS was currently working on a single multi-year EAD card that will also replace the Advance Parole document. What a smart calculation it was in the new fee rule-making action

LOU DOBBS: and theyre indulging in pure BS.

AMY GOODMAN: OK. Now, let me just

LOU DOBBS: And so are you, when you quote them.

AMY GOODMAN: Let me just talk about some of the guests that you have had on

LOU DOBBS: Sure. Theyre not guests.

AMY GOODMAN: or quoted on the show.

LOU DOBBS: Barbara Coe was never a guest.

AMY GOODMAN: No. She was quoted on the show

    LOU DOBBS: Thats different.

AMY GOODMAN: bitterly attacking Home Depot for betraying Americans, apparently because Hispanic day laborers often gather in front of the store looking for work. Not mentioned were her group, listed by the Southern Poverty Leadership Council as a hate group, or the fact that she routinely refers to Mexicans as savages. Coe recently described herself as a member of the Council of Conservative Citizens, the white pride group formed from the remnants

LOU DOBBS: What year was that?

LOU DOBBS: What year was she

AMY GOODMAN: which Thurgood Marshall called the Uptown Klan.

LOU DOBBS: My god, Amy, what year was that on our broadcast? What year?

AMY GOODMAN: Not clear. You can tell me what year was it on your broadcast.

LOU DOBBS: Well, actually, I can, but it was years ago. And it was before we knew what the heck was going on.

AMY GOODMAN: Im going to talk about a few other people.

    LOU DOBBS: Sure.

AMY GOODMAN: Glenn Spencer, head of the anti-immigration American Patrol, has been interviewed at least twice on the show in 2004, maybe many more times afterI dont know. Spencers website is jammed with anti-Mexican vitriol. He pushes the idea the Mexican government is involved in a secret plot to take over the Southwest

    LOU DOBBS: OK.

AMY GOODMAN: facts never mentioned on your show. His group is regarded as a hate group by the Southern Poverty Law Center and the Anti-Defamation League.

LOU DOBBS: You know, well, I really dont care what

AMY GOODMAN: Spencer has spoken at least twice to the white supremacist Council of Conservative Citizens.

LOU DOBBS: You know, I got to be honest with you. I have no knowledge of this fellow. I have no ideaand youre not telling me when he was on the broadcast.

AMY GOODMAN: You had him on the show. I said

LOU DOBBS: No, I did not have him on the show. He was quoted

    AMY GOODMAN: January 7th

LOU DOBBS: He was either quoted in a piece

AMY GOODMAN: No, no, no. No, no, Lou. On January 7, 2004, and June 4, 2004

    LOU DOBBS: Ah!

AMY GOODMAN: he was interviewed on your broadcast.

LOU DOBBS: He was not on our broadcast. He may have been in a field report. He was not on our broadcast. And, Amy, let me ask you a question: have you checked to see how many guests weve had on our show in the course ofwhat is that?

AMY GOODMAN: You have had many.

LOU DOBBS: three-and-a-half years? No, I mean

AMY GOODMAN: You have had many.

LOU DOBBS: lets get a number. What do you think? Why are you focusing on two or three?

AMY GOODMAN: I can go on and on.

LOU DOBBS: OK, keep going. How many?

AMY GOODMAN: But I think the important point here

LOU DOBBS: Give us a total. Give us a total of the number of guests you object to.

AMY GOODMAN: Lou, I just want to say something here. You just said to Juan, cant he take a joke, when you talk about the incursion, Mexico taking over the United States. Yet, it is a growing theme. It is a continuing thread in your broadcast. This guy, Glenn Spencer, whether he said this on your show or not, Dobbs has not

    LOU DOBBS: Oh, no, no.

AMY GOODMAN: Just one secondhas not mentioned his ties to American

LOU DOBBS: Now Im supposed to be

AMY GOODMAN: Yes, you have to know who

LOU DOBBS: Im supposed to be responsible for what he says off my broadcast?

AMY GOODMAN: No. You should know that he was tied to American Renaissance, the group that says blacks are genetically inferior to whites. You didnt report those ties or mention Spencers

LOU DOBBS: Do you think we knew it?

    AMY GOODMAN: more wild-eyed contentions

LOU DOBBS: Do you think we knew it?

    AMY GOODMAN: such as his

LOU DOBBS: Amy, do you really think we knew it?

AMY GOODMAN: Just listen to thissuch as his prediction

LOU DOBBS: Do you really believe we knew that?

AMY GOODMAN: that thousands will die in a supposedly forthcoming Mexican invasion.

LOU DOBBS: Oh, come on! Youre giving Glenn Spencer and other detestable people who would make such comments about more air time than anybody.

    AMY GOODMAN: Well, Lou

LOU DOBBS: You have just given him more air

    AMY GOODMAN: But, Lou

LOU DOBBS: than I would have ever, and I

AMY GOODMAN: But, Lou, let me make a final point.

LOU DOBBS: Go back and look at the quotes.

AMY GOODMAN: Let me make a final point.

LOU DOBBS: Whos giving him more air time? You.

AMY GOODMAN: Your colleague, Wolf Blitzer

    LOU DOBBS: Yeah?

AMY GOODMAN: on the other hand, also featured Spencer on his own show, but reported Mexicos official response that SPLC, Southern Poverty Leadership Councils hate group designation, said that he was a member of a hate group, as designated by the Southern Poverty Law Center. So were not

LOU DOBBS: What year was that?

AMY GOODMAN: What Im saying is that Wolf

LOU DOBBS: What year was Wolf Blitzer?

AMY GOODMAN: Blitzer identified him; you did not.

LOU DOBBS: What year? What year?

AMY GOODMAN: Well, I just know when you had him on your show, and you may have had him on since then.

LOU DOBBS: But do you know when Wolf Blitzer had him on?

AMY GOODMAN: Well, soon after that, I suppose. I dont know.

LOU DOBBS: OK. After we found out that there was a problem.

AMY GOODMAN: But you know what the fact is? I dont know. And I admit when I dont know. And I try to get my facts straight.

qasleuth - You do not even deserve my reply. So you are free to write anything that you want!

why ? is that how you respond to a co-worker or manager at work, if you do not agree with them ? Repond like a grown up with rational arguments.
Setting aside moral and ethical arguments: three of your five suggestions are plain wrong, financially speaking:
taking new credit cards, buying a new car, renting an apartment. Interest rates are not locked and do you know, financial institutions can close your account and ask for the balance ? renters run credit report every time you extend your lease and can kick the renter out. These transactions may seem seamless for a person with decent credit but are extremely damaging for a person with very poor credit.

Leo2606, Being ethical is not a fancy word in business, in the long run (I am not talking about decades) your partners, customers and lenders will know about your practices and run away. Ethics and Morals are not something you take lightly especially when you are running your own business.

Being unethical can lead to legal problems apart from business losses. There is prudence and judgement which needs to be exercised, does not mean you do not have to be smart.

Don't waste your time and money by stopping in EU or Gulf countries. Take continental direct flight from newark to delhi. Yesterday flight took only 12Hrs.

    Smisachu,
I am happy for you. The process indeed takes an emotional toll on us. Thanks for the heads up about the type of mail. I will be careful to watch out for "credit card offer" type snail mails.

After you get the CPO, the whole process seems to be automated. I think USCIS is using some workflow Product.
I guess in 80 to 90% of the cases , after CPO you shud expect your card in 11 days.

of all the smooth talk..cmon we all know the one time might power ruled the world.. so its not easy for them to get over with..well for those who dont like i always say..just boycott..but i know lots of them will still give in and take the pain...

the way i see..if indian airlines were upto the task.. we could have direct flights from all major cities in US..but then again how can I simply blame the British govt. for tormenting us..its the Indian govt. who can't sort this..either encourage big businesses to launch international flights with world class service..that's something which we have to wait!
how quick we are to blame the Indian Govt.......??

Continental has direct flights to Delhi and Mumbai from Newark, Jet flies from both JFK and Newark, Air India flies direct as well, American flies from Chicago direct.

Many Middle East airlines (Qatar, Emirates) fly from New York to their respective hubs in Middle East and then to multiple cities in India.

Aeroflot ( my parents had a great experience on the airline - good food, courteous service and good new boeing planes) flies to Moscow and then to India.

West Coast folks can fly via Singapore or HK or Malaysia........

With so many choices - why should we even bother to patronize the London airport - i have no idea.....

Though i have a GC and dont need a TV for london - i hate to patronize such unfriendly airport systems.

Section 501 and 503 would help retrogression a lot.
