An attorney I know told me today that:
(1) they believe EB2/3 mid-month retrogression is unlikely in July based on coversations with relevant folks in govt.
(2) USCIS is unlikely to want a spirited fight from AILA by retrogressing mid month, especially given the fight that's already on about June EB-3 unskilled
(3) The June EB-3 unskilled mid-month should be viewed in the context of the just 5000 visas that were left.
I am not going to qualify the attorney by firm name or with adjective phrases such as "very high profile." Nor am I going to quote the attorney in multiple colors. Posting it here for what it's worth (even though I realize this would sound totally bogus if I were to start this post with "a bird told me that...") None of the above is secret knowledge; apparently other AILA attorneys are also up to speed on these points.
In any case, however relaxed attorneys might be, we should probably work on trying to hit that ever-moving target of "as soon as possible," if we want to see the smile that an EAD card will bring to dear spouse's eyes.

I would change my contribution to $50 monthly if we have 1000+ members to sign up for the monthly contribution. Meanwhile, I would cancel my contribution if this goal cannot be achieved by all our 8400 members within the next two months. I cannot see any point if most people who suffer from the possibility of waiting for years would not contribute while I, who might be one of the least painful ones, contribute.
No offense, but, I would continue or increase my contribution, not because someone else is doing so or not doing so, or not if I would I get a tax break or not, but just because of my sheer appreciation of the IV core group's amazing efforts.
I have not (in the recent past) seen such a group of dedicated, decent and diginified people working together in a selfless manner to achieve something not only for their own good but for the good of hundreds and thousands of their fellow "sometimes not so polite, not so patient" sufferers.
I see my contribution to IV something similar to a contribution to a church or a temple. You give, not so that you'll benefit out of it, but because at the end of the day it is money well spent for a good cause.
If you benefit out of the efforts possible by your contribution, that's a nice bonus.
I don't look at my contribution as "I pay $20 I should get $100 in return".
For me, it is not an investment, but a good expenditure for worthy cause.

I do not know if I am doing something against the rules of this forum, please excuse if I am. I am just a father trying to do something to protect his daughter; but I know that there are many other children who are or were under similar circunstances. I am not a lawyer. My wife, my daughter and I went to talk to our Representative Moran and our Senator Webb, but they are interested in numbers, cases, especially Virginia residents; but I think that this is something national. We (my family, I and anyone who wants to join us) can go to the office of the Leader of the Senate Majority or the House or to the office of any other committe leader and give them a letter showing numbers and cases, real families that are suffering and requiring them to do something about it. If you agree, I would suggest to prepare a small database with all the cases that we know, then prepare a letter and send it to the Congress leaders.
I think that we would need the following information:

I live in LA and sent my renewal application to NSC on April 1st and reached on April 2nd, but they forwarded my application to PHX. Arizona, then check cashed and recieved reciept in mail on April 21st. it took 21 days for me.

Now, I see this trend - needhelp, tamsen and so many girls giving flowers to logiclife ............. and logiclife not accepting them .......
I think the issue here is, logiclife is flooded with these requests and has retrogressed accepting flowers - he will be announcing priority dates soon - and probably per country limits also. So please keep cjecking the special bulletin logiclife will release every month :)

I called up the number yesterday and luckily some lady picked up. She was not even willing to answer :((. When I asked about the status, she said it will take 20 days time. I dont know why they have mentioned it in website as 7 business days. I think indian consulate doesnt know the meaning of customer service. In this modern era, why cant they keep a site to track our status...

I have applied for birth certificate at Indian Consulate, SFO and received from them. They simply attested the information on my Passport on their letter head..will that be sufficient or I should get it from MRO/etc from India?
The birth certificate you get from the Consulate is not sufficient for I-485. If you don't have a birth certificate from the Municipal corporation of the city where you were born: then you need a Non-Availability certificate from that Municipal Corporation + 2 affidavits from close relatives.
Check with your lawyer for more information.

The mystery is solved. I have corresponded with Charlie Oppenheim in the Visa Office. He confirmed that the 27% limit does apply. He explained that during this fiscal year, the CIS consumed an unusually large number of Indian EB2 visas, thus making the category unavailable despite a retrogression in the cuoff date which was intended to hold number use within the limit.
He said that based on his discussions with the CIS, he was informed that the CIS did not feel that the current amount of pending Indian first preference demand would be insufficient to use all available numbers under the limit. Therefore, he allowed some of those numbers to fall down into Indian second preference.
So, the Indian second preference numbers used to establish a cutoff date for April are coming from left over Indian first preference, not worldwide numbers.

An idea:
Is it possible to recite the oath of citizenship in front of the senate en-masse? And maybe get some reporters to report the event..
Another, letter campaign, in which people will sign on the oath and snail mail to WH and also local senators
These might bring attention to us.. but feel free to knock it down (or ignore) if sounds absurd

There may be some EB2 Indians with PD in 2002 and 2003 (with traditional non-RIR LC) got out of BEC recently. If 1,500 Indian non-RIR LCs (with EB2 PD 2003)certified recently from BEC, that is sufficent to move the date back to 2003 for India again. Having said that, it is all prediction. No one knows, except USCIS. My prediction is just based on the magnitude of 485s (800K) filed recently, as is has all kind of composition in huge manitude, apart from so many 485s already pending due to name check.

Hi Albertopinto,
Can you pls elaborate on why your are suggesting to stay away from day trading? wht kind of exp hv you had with day trading? I want to know the pros and cons and hear the experience from ppl with hands on / who hv tried day trading in the US and found it too risky. Thanks!
As said earlier its addictive(substitue the word 'gambling'), heavy amount of risk involved , limits are high as well and one has to be careful while filing the taxes apart from all the risks associated with the regular stock trading. It aint bad if you can identify the trend and want to make some quick bucks.
Because of the volatility in the markets right now, day trading is thot to be beneficial at this time rather than holding.
But if you are new to trading and have some monies sitting in your checking a/c , I would advise you to put that in ETF's , as this timing is great for entry, as its the bottom of the barrell.

It has been a long journey. 9.5 yrs in this country. I have been a donating member for quite some time to IV and will continue to do so.

Before the first application gets to process, I left the company and joined another company. The GC which I am waiting for since then was filed by the second company. They filed it on EB3 eventhough I was eligible for EB2 for "easier processing". At that time both EB2 and EB3 were current. And it remained the same way till I got my labor approved the very same month it went into retrogression. Since then I am waiting.
By the way, my first company sold the labor they filed for me for $15K dollars to another guy. He got his GC in 2005 and just 2 months back he became an US Citizen.
That is a long story told short....

Spoke with Carl Shusterman today and he has requested a copy of my law suit.
