What should we do to pickup our file? Any thoughts appreciated
You really cannot do anything in a short time except hoping for the best. Two things have to happen for getting a GC (i) Your file should be or should already have been reviewed, and if all good to go, preadjudicated. That depends on your receive date by the Center processing your case (not RD on your receipt). This date is close to ND, and is often seen online as " your case was received on...". If this date is prior to published dates, your file definitely has been reviewed. Farther it is from the published date, lesser the chance, but approvals are indicating that if it is Aug, Sep, Oct 07 there is very good chance, though September has higher chance than October (ii) Your PD should be high enough. As per USCIS SOP preadjudicated files are piled in sequence of PD's.
Note that both conditions should be met before leftover visas exhuast. Third condition, which always plays significant role is, luck. This means, you hope that IO working on your case did not fall sick when he/she was about to look at your case, some document did not slip out of your file, person working on your case head proper eye glasses so as not to misread your PD as 2007, stack of preadjudicated cases did not fall down losing file sorting sequence, etc. etc.

Is there a possibility of aug bulletin, as USCIS has started returning visa numbers? (as per Lofgren's statement)

I had my fp done on June 19th.
When I spoke to the IO they told me that they have received my "approved" FP on 7/22
I hope i can get the same kind of information from the IO. Will try it today.

ok, there is a lot of prediction that the dates will move from C to U in the very near future. What does it mean for people who currently have I-1485 applications pending? Does it mean they have to wait until the dates move from U to whatever their PD is? if it moves to U in Aug, I think it will be in Oct when it will move again to sometime 2003 (given the large # they are about to receive).
Any ideas about this?
They wont adjudicate the applications until the quota for your country and category becomes current for your PD.

My friend was in same situation couple of yrs ago and doctor advised not to take immunization as this will affect the pregnancy (baby). so the INS doctor mentioned this in medical form and she did the immunization after delivering baby (almost 2 yrs after filing I-485). so this is not a issue, before your I-485 approval USCIS they will send the query to put vaccination and at that time you can show that you did by showing proof of vaccination.

Congratulations!
Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

I know , I can not walk 10 miles (Army 10 miles, Washington DC)- forget running.:) Can I still be part of this?
I think, apart from running and walking 10 miles I am able to involve myself doing other expected activities. In my life time I have not walked 10 miles:)..Man, you guys are tough.
Note: I may be able to walk 2 miles.

Hi folks, good to see great moment in IV with regards to advocacy efforts. I still remember the day I attended the rally in DC conducted by IV. I cant forget the crowd. Amazing.
Update on me - r2id in feb. Joined the new job. Enjoying every bit of it. Initial challenges as expected in settling down. But slowly things are moving. Got admission in school for kids, took an apt for rent etc. Just wanted to stop by and congratulate everyone in IV on the advocacy efforts.
GO IV..ians..This is the year we got the world cup. This could be the year where we get through to the lawmakers and make them understand the agony of so many families waiting in limbo in the GC queue. All the best.
Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.
Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.

Hello,
They may have done the prevailing wage (DOL website has this info) and LCA online. Employer can do their LCA online and get answer/approval within minutes. Once the approval is signed, I-129 can be filed on the same day. My employer did these things when they filed my H1B (I got it 5/6 months later).

EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1. :mad:

1. The fee is $340

Admins or mods must change the title of the thread. This is going to disappoint a lot of our friends in this forum.
Well this thread has a good begining and then some suspence and then a dose of harsh reality.
Isnt that the story of some of us who came to US with a rosy picture in our mind and worked hard and the immigration system in the country gave us heartaches and headaches!!
It also tells our members how difficult getting a law passed is. We all need to work harder and harder to get anything done. We need everyone's full support in order to achieve our goals.

I interfiled to EB2 but do not trust that they have applied that, service request goes unanswered. So they may be processing as EB3.
