Most of the American companies won't hire from India or other international locations. Consulting companies are catering to this need of american businesses where they want the candidate in US. They do a pre-screening of the candidates and make sure they are good for US job market. BTW many of these consultants are highly competitive. Otherwise they won't survive in US job market.
Majority of us won't be here if it were not for these consulting companies. I don't think there is anything wrong with consulting firms. Many of you who graduated from US universities were hired just for the fact that you were already present in US. ( also thanks to the tie-ups of businesses with universities)

I agree with you. Even though I have been in a permanent position all the time I agree with you. This is because I have been through so many layoffs in the last 6-7 years and this is the reason I am suffering to get GC. At least you have sense of job security and maintaining status if you are in consulting. And there is zero tolerance when it comes maintaining status if you are laid off for H1 conditions. At one point these people say that they do not want employers to exploit workers so they have created these LCA rules of getting paid. But on the other hand they have these stupid policies of zero tolerance when it comes to getting laid off. American way is employment at will from both sides. So an employee can be laid off anytime one day. And in layoffs they don't care about your skills and experience. They just scrap the whole products.
I can go on and on. Bottomline, consulting companies should be held accountable for the violations like not paying employees on bench but at the same time they should not have to be subjected all these stupid policies like to produce client info before getting the H1.

If I apply for GC with the possible point system in the last couple of years of H1-B, would I be allowed to continue extending my H1-B like the current EB Process?

I have a small question, how early can we go to the doctor, meaning can we go now although the ability to file triggers from July 1st or does it have to be that the medical examination has to be done only after July 1st

I would be in the same situation but the companies which did not let their employees file EADs in the first place would not be willing to provide the Receipt notices to them. They will instruct their attorneys to hold on to the RNs or and not give even a copy to the employee.
Any thoughts?
You can get the Receipt# from the FP notice or by calling USCIS, and use the online case status printout to file EAD. I believe this should work.

I send email to NY,DC and Houston Germal Consulates.
Didn't recieved reply from DC office yet.
NY Office replied as Transit Visa is required for AP holders.
Houston office replied as Transit Visa not required fro AP holders.
I called AIR India multiple times and they said NO Transit Visa is required.
Usually if that is required, the Air Lines should stop us even before boarding the flight.

How do you attach phoographs ? staple on the top of each form ?
I would suggest that you get a small transparent plastic sleeve, put your photographs in it, fold the top of it over the app. form and attach it the application using a paper clip. This is to avoid damage to the photos. Be sure to write your name using a pencil or other on the back of the photos as well as your A#. Unless the form has a space that says affix here, I would follow this when sending in the app.

Why are you skeptical about everything? Now you are able to file I485 and celebrate and file it. When PD goes back see that time. Some thing is better than nothing. If you get gc you will worry about citizenship.

Like many of you I heard/read conflicting information about vaccinations, so I decided to do my little research and take data from the sources and not rely on others. I hope this helps others.
Vaccination Requirements for Adjustment of Status(aka I-485) applications

Section 212(a)(1)(A)(ii) of the Act states that the applicant is also required to have any other vaccinations recommended by the Advisory Committee on Immunization Practices (ACIP). The ACIP provides guidelines on appropriate doses of vaccines at specific intervals for specific age groups. The varicella, influenza, and pneumococcal vaccines are also required, because they are currently recommended by the ACIP.
From the highlighted list above, only the following are administered as a "standard practice" (per my county health person).
MMR (Mumps, Measles, Rubella)
Td (Tetanus and diptherial toxoids)
Varicella (Chickenpox)
You first goto the USCIS authorized Civil Surgeon to have physical examination
He/She examines and recommends if any immunization is needed
You get the recommended vaccinations
Go back with the proof and he/she gives you the complete report (I-693) - sealed.

Guys, I am also in the same boat as you. 3 years Diploma + 3 Years B.Tech. Applied I-140 in EB2 category and received an RFE about my 3 years Engineering degree.
This is so depressing, first of all Getting 3 years Diploma + 3 years B.Tech is tougher than getting a 4 years Engineering degree. How can we convince these people? I am so depressed. Can anyone kindly send me sample university letter, I will also try to get one from my University (AU). God only knows how much time it will take for them to respond.

I understand your frustration. But cool down. Core team is doing what they have to. Please every one keep in mind before blaming core team that every one is volunteer !! (They are not pay roll of IV)
I agree, even taking up this initiative is a commendable job by IV core, let alone being volunteers....and I appreciate them for that.
I do know Waldenpond had set expectations of nothing much in LD session, but since we are hearing otherwise from different sources, we want to make sure that if any H1B provisions are passed, EB provisions are not left out.

John Shadegg [R-AZ] in the House.
"The Cornyn-Shadegg SKIL Bill is a Trojan horse with a risk of being attached to an unopposable omnibus appropriations bill in the
lame duck session" of Congress, Berry said in his alert.
The bill would raise the cap on H-1B visas from 65,000 to 115,000 annually and would create a more flexible system that adjusts to so-called market demand. It also exempts foreign nationals who have earned a Master's or higher degree in an accredited U.S. university from the H-1B visa cap.
Opponents of the bill say that both Democrats and Republicans will more than likely pass the bill as they seek the support of companies who seek to increase the overall labor pool of skilled workers.
While both the House and Senate bills are sponsored by Republicans, Berry said that most Democrats have supported H-1B in the past, and one can only assume they will again.
"I'm not aware of any Democrat who ran for the House that opposes Bill 5744," said Berry.
Norman Matloff, a professor of computer science at the University of California at Davis called the bill an "unwarranted expansion of both the H-1B and employment-based green card programs."
Matloff refutes the claims of a high tech labor shortage.
"The impact of this bill on U.S. citizens and permanent residents in the tech field will be quite harmful," Matloff said, claiming salaries adjusted for inflation have been flat in high tech since 1999.
Berry proposes increasing the H-1B visa fee to $5,000 per year to subsidize the education of U.S. engineering students.

Please don't get me wrong. I truely appreciate all the efforts of the core team. My intention in saying what I did was to put the info in a truthful manner as I saw it. And let me the first to say that even if the current senate and house is not able to adress our concerns before its term expires...just by having them pass incomplete bills with our provisions sets a very good precedent for the New congress after Nov elections.

I applied for my AP on Oct 20, 2009. Booked my tickets to India for Dec 13th. Received my AP only in Dec 31st. Cancelled my Tickets and lost 700 $ on tickets. Thanks to USCIS.

In case you are concerned then the best recourse is to take an infopass and see if it can be expedited........

I am a Software Engineer , with Masters in Computer Science in EB2 , but EB2 applied with BS + 5Yrs exp, my company didn't want to show Masters as an requirement, since not all SEs have Masters. Will my case also come under STEM ? Anyone else in the same situation ?:confused:
I am in the same situation, MSEE +5 years exp (of these 4 years are in USA on H1-b). Lawyers filed EB-3 rather than EB-2 because MSEE was not an absolute requirement for my job position.
As I read the proposed bills, it appears that the STEM provisions will not be related to EB-2 or EB-3. It just states that if you have an advanced degree and 3 yrs experience in US prior to application you can file I485.
