485 instruction states the check should be payable to "Department of Homeland Security", 131 instruction states the check should be payable to "U.S. Department of Homeland Security"; other people here said should be payable to "USCIS". Which one should we use? Anyone, thanks

USCIS should have denied the H1B applications from the companies which they think are incompetent. After being here and worked for some years and all of a sudden denying applications without proper reasons which they didn't find first time is rediculous. People have families and they must have planned things for themselves in this country. Instead they should scrutinize applications for the first time instead of going for lottery system. And they should have a system like the companies must be compliant with some standards something like that sothat people will choose those companies.
Finally prevention is better than cure as you guyz know...no more comments..

Is this because of the lack of tech jobs here or because of the increased scrutiny by USCIS etc, I do not know. Looking at various IT markets, I think there are many IT jobs in the US.
So H1b filing is down simply because of the tactics by USCIS and the reluctance of employers to go thru all hassles of hiring an H1b. The US tech industry and US in general are the victims here.
The opposition to H1b and other EB visas will continue as long as the general US public see all immigration as the same (both illegal and legal). I feel, we need to work hard to correct this wrong public perception.

Thanks and explain to your attorney about your case. My attorney also didn't understand all this but I sent her so many emails, talked on the phone and drove to her office (2 hrs drive) and explained about this whole education pattern and finally she was convinced. If you submit a good evaluation with appropriate wordings in the first place, it's higly likely that your case will get approved without RFE.

I am in the same boat, I got a letter from DBEC on 6/30 (can you imagine the letter was dated 6/15) but till date (7/13) my lawyer has not received any communication.

Canadian PR looks good and donot need ATV if you are travelling to Canda, but its unclear if its exempted when travelling to 3rd country.

I am busy too. But I still found time to read your thread. I cannot but laugh at your ignorance. Do you really think someone posting on his website will help solve your problem without doing lobbying. You guys could not even get more than 5 people like you and could not even have the courage to have all 5 of you appear for the interview.

This is a very small movment composed of around 5 people. now YOU have to answer the question, Why not more than 5 people support this movment? Is it because a lot of us consider this "not my problem?" Why should I even support this?

My LC Sub I140 got rejected a month back on education (Dip+AMIETE+MS-bits) after an RFE in EB2. USCIS didn't recognize MS from BITS, Pilani, India is equal to US masters. Our attorney got it evaluated as both are equal. (LC has Masters+2, which I have)
I already have another approved EB2 I140 which was approved in premium processing in April from Texas and we requested to use that I140 for my pending 485 in April, 2007. But we got intent to deny letter for this approved I140 too in early November from NSC. This approved I140 was from TSC, and 485 and first I140 filed with this 485 (rejected I140) are pending at NSC. My attorney replied to this letter last week showing my AMIETE is equal to US bachelors since they are not recognizing my MS. LC has MS+3 years or equivalent (BS plus 5 years progressive experience), but BS lacks 'or equivalent' word and not sure what is going to happen. The attorney is from a big firm. I am waiting for the reply from USCIS on this I140. Luckily my company extended my 8th year H1B immediately which now valid until Jan 2009.
I believe, the whole process is just depend on shear luck of individual.

My PD with my previous employer is JUne 2006 and I-140 was approved in August 2006. Since then I have changed the employer and the new employer is in the process of filing PERM again. Would this cut-off date of May 21st 2007 would effect my case. My current employer would be filing a new I-140 at a future date which I don't know at this time.

I am in the same condition , but i finished my MS in USA so mostly didnt have any problem in Clearing my I 140 , i have a letter issued by Madras University , stating the admission process for diploma holders , ican mail you a copy of the same , but i am in india now and will be back to US only after may 20 .

No, because the first time that NCS gave him a claim confirmation was November 9, so, he told me that he needed to wait until December 9 to proceed through AILA. However, in addition to continue calling to National Customer Service, he sent form 7001 to Ombudsman, and a letter to the Texas Service Center.

Doesn't make sense :confused: since the total pending 485s are 233,816. With a total available 140,000 visas minus around 15% for consular process makes 119,000 visas available per year (assuming numbers aren't wasted and spillover is efficiently applied). How come it will take another 15 years for my number to become current? Something's wrong with the IV calculator. But thanks for the effort. I had travel plans in Apr 2024, will cancel them now since my number will come up for adjudication in that month.;) Thanks for the headsup! :rolleyes:
