My lawyer took a long time to send the response for the 45 day letter. I think the deadline date is May 29th of 2006 and the lawyer sent the response on the 25th. Being that 27th, 28th and 29th are holidays id my file doomed?

We must lobby the Governor on this issue. She has expressed interest in both keeping jobs in Michigan and in the Innovation agenda. Repeatedly speaking about attracting IT jobs, Biosciences jobs, and alternative fuel technology etc. None of this is helpful to do that.
She can push the legislation suggested by Terri Lynn Land at the very least.
We must convince her that, targeting legal immigrants this way WILL cause them to leave the State even if not the Country. This will hurt Michigan.
If this rule stands as is, I for one will be moving out within a year. My job prospects are good and frankly this would be too much to take. I suspect I will not be the only one doing so. Michigan's competitiveness will decline substantially.
Michigan in my view can ill afford this. Michigan lost 30K people net last year. Housing is in the slump of slumps, coming in at the top for foreclosures and with price declines averaging the coastal markets, bearing in mind Michigan did not have the run up in home prices in the first place. This would be another nail in the coffin for Michigan's economy.
I do feel she (the governor) is likely to take heed to our concerns. She has been rather quiet during this entire period on this issue.
What do you guys think is the best way to get her attention about this issue?

I do have a question. Let's say Company A has a contract to build a very complex forecasting system. This company wants to get a Math Ph.d from a foreign country, because the contract it has got involves very specialized skill not found anywhere in US. However this person is under contract to his/her company and cannot accept outside independent employment. Company A which is the contractor is forced to sign a contract with the person's company.
The person needs to be onsite to interview the Business Stakeholders to model the rules correctly.
Per Durbin's rule, there's no way Company A can complete the contract.
Rules need to be enforced uniformly and CIS in it's bureaucratic haze does a brilliant job of being blind to a person's need or qualifications.
This is a rarity, but I do concur with my anti-desi consulting companies colleagues that the norm is to get a very average techie. However your behavior is no different than the NumbersUSA or Prog Guild fanatics/whiners and it reeks of "Let me in and shut the door".
Yes immigration needs a boundary, but why isn't anybody doing anything about green card lottery where a high school passout with access to the Internet can get a green card or the humongous family based immigration route better used to staff 711/Dunkin Donuts than truly reuniting families.
There is a difference angel...I am not against hiring foreign workers and bringing them in the country... I am against the fraudulent practices employed by these desi consulting companies and the massive exploitation... Bringing someone from India with a fake degree.. then lying on the resume... and these lies are massive... a guy who landed yesterday will be shown to have 7-8 years experience and Masters degree in from a US university... The guy would then be interviewed by the desi companys own person who will get a cut from the new employees hourly wages... Then other consultants would be then given the new persons work and the new guy will be slowly trained... meanwhile he is paid measly wages while everyne else shares the booty from the new hunt! How can you not be disgusted!! Family based imigration and gc lottery cannot justify the desi companys fraudulent activities!

In this context, Petition for employment visa means I-485. Atleast that is what USCIS will interpret
what I think (logical common sense) is anyone who applies LC/I-140/I-485 before OCt 1, 2008 (or the date on whcih new system begins) will fall in the old system otherwise i am not sure what will one do between this time frame (may 21st, 2007 - Oct 1, 2008). Can't afford to just sit there doing nothing. Or I am just imagining ????

As there is not enough response....nothing is happening on this front. I think its little difficult to arrange on Mar 1st as its already Feb 10th.

First of all USCIS does not deterimine the visa dates. It is Department of State that does determine visa dates based on application data from USCIS and DOL.
Secondly, we already have a substantial challenge to get people to work on IV's intrinsic activities i.e. sign up new members, get more funding, organize state chapters, talk to local politicians. I think NumbersUSA information is good to know. However I think we are getting side tracked by getting into too much information about NumbersUSA, their intentions and about predictions on the future of CIR. For now our energies are best consumed on working on core IV objectives. That is just me.

So when you get it this RFE....Did you change your employer using AC21, how did you manage,,,did you transfer your H1B or using EAD.....Did you apply new Labor from your new company...
My case, I got my 140 approved 7 months back, 485 pending for more than year...so should I use AC21 and change the company........my priority date is Oct 2003 EB3-India, how can they say 140 is fraud after its approval...I am working for the same consulting for more than 5 years...can you please clarify..

When i initially got RFE, i didn't know at that time that there were already few H1-B's denied from my company. I believe last year when CSC started processing H1-B's they issued RFE's to lot of companies. Most of them got through even though they had few issues but unfortunately my ex-employer got caught and they have denied majority of extensions and new petitions with the reasons i have mentioned before. Till that time, i didn't had much knowledge about the process. I thought i was safe coz my W-2's were almost double the amount that stated on the labor and i was employed, i have provided all the client details, PO and everything. Inspite of that, my extension was denied. Coming to your questions, i have moved out of the company after 6 months of my 485 filing. I haven't filed any H1-B, No AC21(just change of attorney) and i also have an another 140 pending with my new employer and i don't think that 140 is going to work coz there are lot of complexities. Talk to your employer about this. Are you the only person in this situation or anyone else with you in your company. Are there any other petitions that are recently being approved or denied? He is the right person who can tell you about your petition. If you think your employer is not that good by sticking with all the rules,you still have time to move to another company. Even if your petition gets denied, if you want to maintain H1-B status, you can still do that, but there is little bit of extra money involved to get back on to it.
There is nothing to be nervous about this coz there is very little that you can do about this. Majority of the companies got this RFE and lot of them got out of it. Looks like you have a good relation with your company ( 5 years is a good amount of time ). Please talk to them and make a decision based on what they have to say..Hope everything goes well .. never know u could be green before your extension decision is made..Good luck..

You are right: USA is much better than India but, it is NOT our country and we dont have any place in society except being used to make this country stronger in return for measly benefits (slightly higher than what you would make in India). How does your life change after GC? You will probably be making a little bit more but it doesnt solve your life problems. Some other worries will start.
Very first think comes to my mind is why are you guys coming to US if you feel India is better. Have you seen anyone from US going to India and taking up jobs. Again dont get me some exceptions from here and there.

But I think your point 1 is a very loaded statement. For some people culture/parents/siblings might mean more than others. It may not have meant much when they left India but over the years they may have started valuing these things more? Is that good enough to make a decision? Only an individual can answer.

Administrator please close this thread its just creating panic attack in people esp around something which is not true. GCard_Dream just came up with a date. My lawyer (Fragoman) confirmed there is no way USCIS or anybody will enforce a date of May 21st( the day bill was introduced).
