Oh, that's good then, I can expect my approval soon, PD EB2 June 2005 / 140 cleared and Name Check cleared. Pretty straight forward case

maybe this is a stupid question - once 485 is applied, and if dates retrogress later, we can still go on renewing EAD, right?
will the final approval be issued only if the date is current when they get to processing the 485 application?

AOS is your status- This allows you to stay in US as long as your application is pending/approved.
EAD is work authorization. This allows you to work in US.
If you have I-485 pending and no EAD/H1, you cannot work. However you are eligible to stay in US as long as your 485 is pending.
While the section u r quoting are supportive to ur opinion, which all of us had all this time, the sections Sledge_Hammer pointed out are more clear about the distinction between, Status and Presence. It actually contradicts ur view. If IO reads those sections, he can order deportation of AOS candidates with no H1 extension. Its very contradicting...

QP, we have had various PM's in the past, and we even worked together for a common cause :D
I really do believe that things have finally fallen in place, and the wheels are in motion. We are slowly getting the momentum from our fellow peers. Just the co-ordinated effort this past week was a very refreshing experience. It was nice to see many of the folks come out from under their rocks and fight for the cause.. These calls have definetely made an impact on the house reps and the senators. Hopefully with our membership growing, we will have an even bigger voice next year :)

What happens if I owe IRS next year and doesn't qualify for refund?
I hope folks here know that the tax rebate check is an advance on your 2008 tax return. It really doesnt matter if we get 600/900/1200 because when we file return in 2008, IRS will deduct the money from your refund. No free lunch!

This is what my lawyer wrote to me when I asked him if the May 21, 2007 date has any significance-
"At this point it is unclear what affect any pending legislation will have. My best guess is that whatever legislation is passed, if in fact any is passed, the legislation will only become "effective" at some future date, at least several months from now."
I agree strongly with this. Also, the application of effective dates maybe left to UCCIS's discretion e.g. LC substitution elimination final rule.
Although since this legislation affects issuance of actual visas (green cards), for example they have a cut off date for Z visas. That date is probably concrete. Or is it ?
I guess as of now it is.
If it takes years to really implement this new legislation I guess people with current PD's should be able to go ahead.

That is exactly true. There is something fishy going on . Only for EB3-I the dates don't move forward whereas Mexico etc have many more cases than us. It is as if USCIS does not want to give GC's to Indians.

If you heard that extreme position from a member of a certain group that is a disgusting, but doesn't mean a lot. Members of any group can outrepresent ideals that doesn't necessarily speak for everyone. Comparing them to KK for example seems to me equally radical and irrational.
I agree with you. These groups are not very different than Klu Klux clan. I have once heard a member of this group say on TV that foreigners should carry identification papers all the time and also should have separate lines in grocery stores. Anybody (I dont need to name him/her anymore because I want to ignore this person) who exchanges emails with them is passing on info from this forum to them.

As far as I know, I-485 is not the petition for Visa whereas, I-140 is the immigration petition. Your I-485 stems from the underlying I-140. I-485 is merely an adjustment of Staus from non-immigrant to immigrant intent if you are already in this country.
Let's see how this all plays out. After seeing yesterday's amendments, all my anxiety changed into laughter as that's how pathetic this bill is at this point
What were yesterday's amendments? How do you guys find out what the amendments were. I'm a novice in this area. Please enlighten.

As EB-2 is current ,I had a question. My spouse is on H4 , and have applied for H1 and for change of status(H-4 to H1, H1 status from October).Can i file her papers along with mine in I-485 or not?

One thing that most people here do not understand is that Universities have only two different categories for both admissions and Financial Aid: GC or Citizens get normal treatment. Everyone else, whether they are on AOS or H4 or any other status are considered International Students both in selection process and for Financial Aid. It is very simple - International Students are Not Eligible for Any Financial Aid. They will have to pay Full Fee, which is about 50k/yr in good Universities.
If DREAM Act covers Legal Kids, it will cover those in AOS too, which will enable them to get GC before their parents do and be eligible for selection as a local and for the Financial Aid that locals (GC and Citizens) are eligible.
Getting admission in good Universities is extremely difficult as an International Student as they tend to have a separate quota for international students, even though they refuse to admit publicly that they have such quotas.
I know these because my son went through all this last year.
