Thanks mwin - Are there any USCIS or DOL laws which state that i have a right to get copies of all these docs like LCA, 129, withdrawal letter, etc...! even though i will not work for that employer.!!...Should i worry about this pending H1B especially when my wife already has her current H1B valid...Would extension on this current H1b be a problem.?? Whoa...now..u are jumping into conclusions. I saw the movie on the first day it released. I'm a big fan of Jamie boy. Spent last week about how he transformed from a truck driver to a second unit director and then to make the best movie of all time. I have a whole bookmark folder for this. How long did it take for you to get receipt numbers? Were your checks cashed asap?
I would like to hear more on the employer letter salary part. Do we need a number on the letter or the wording " salary as stated on labor cert " good enough?
My receipts arrived within two weeks. The checks were cashed ahead of that by about four days. Had finger print appointments within a month of applying.
My employers letter stated my salary precisely. No mention of labor cert amount or anything like that.

I know chances are things won't change soon. But if we do nothing, there is 0% of things happening. At least we're trying to do something here.
For me, this EB3 retrogression is forcing a lot of young graduates back into their home countries. Now with a 5 year wait time (My priority date is 2007) I am starting to question whether I can wait that long as well.

Happy to share the news that I received an email saying that "card production ordered" for 485 yesterday. Technically I got greencard approval, but I have not received the card in mail.
However, here comes tough situation along with the good news. I have tix booked to leave to India tomorrow. I'll be return in 3 weeks. Lawyers suggested to go to Infofass in Boston (nearest to where I live) and get my passport stamped with 551. I checked the appointments and there is none available for today. Is there any emergency appointments. There is no phone number available for InfoPass/Boston.
My AP is valid till this December. So can I use it. Lawyer suggests not as there will be intense scrutiny. Horror stories and happy stories shared by friends about friends who were in similar situation.
Does anyone know about this? What are my options. Please advice asap.

A: 1099 can jeopardize her AOS status, google it, please.
3. Can we open a company on her name and can she work through?

If I may ask, what were the revenues of your Indian company's operations and your US company's operations? What was your designation and how many direct reportees did you have in India? Did you take any documentation regarding the direct reportees for your L1A interview?
Sorry to have bombarded you with questions, but your inputs will surely help as you have already gone through the process. Probably, I will discuss my case with a lawyer since it is a bit complicated. Unfortunately they are expensive and I am not sure whether it's worth the try!

When i talked to an IO and at infopass too, its confirmed that
they process the primary application first, and then only look into the dependents cases.
if dependents cases are straight forward and ready to be adjudicated, then the entire family will get approved around same time. in case if more processing is required for dependents cases, they get separated and get approved later.
nothing to panic. its pretty normal if we have to believe what IO says...

Here is an update for all those who have followed this thread...
We had written to Rajiv Khanna's office and they arranged for a phone consultation at NO CHARGE this morning.
Mr. Khanna spoke to us and said that it will be illegal for the spouse to return to US on the Green Card as it was issued after the death in error. Even if she were to come now and go unnoticed, she could have issues sometime in the future. On her question to surrender the GC, he agreed in the affirmative.
Hats off to Mr.Khanna as he turned out to be the most soft-spoken attorney ever that I have dealt with and also for giving us enough time to clear all our doubts. I will certainly recommend him for anyone looking at using an attorney for this long-drawn process.
My wife's friend will communicate with the local consulate in India and ask about their method for surrendering the green card.
Thanks to all the good samaritans (including Mr. Khanna) for helping us clear this.

I received my EAD Sept last week. But have not received FP notice. I find that lot of people here receive EAD card along with a FP notice or some people have not received EAD card yet but have received FP notice. Anyone in the same ship as me?? Any thoughts on this !!
