As mentioned in my previous post, one should at least stay with their employer, at the time of GC approval, for around 6 months to a year .
Then again, nothing about the time line is case in stone (that is nothing is said in the law books). However the shorter the duration, the more the burden on you to prove that you did not get your GC with no intention of working for the employer.
As someone else mentioned AC21 invalidates the requirement that you need to work for the same employer. That is a gray zone. Based on my understanding:
1) When applying for any stage of the processing, you need to have intent to work for the employer (otherwise, legally you have committed fraud).
2) Even with AC21, I believe you need to stay with your then current employer for some period of time after getting GC.
I know people who have left their jobs within a month of two of their GC and have had no problems even with their citizenship. So it is up to you to maintain your own good sense of security on how long you want to stay with a company after GC. Most lawyers' opinion is to stay for at least a year - provided (their boiler plate advice) that you dont have premeditated intention to leave.
Once you are happy and secure with the "cooling off" period after GC, you can work in any field (not meant to deride, but you could also work as a hamburger flipper if you so choose), or take a break.

It is a fact that we are supposed to carry our proof of legal documents.
I always carry a "scanned pdf" of my latest approval notice and I 94 in my iphone. I will strongly recommend everyone to do at least this.
I know a friend who carries a "miniature copy" of approval and I 94 in his valet.
Either way, you will have something besides your drivers license.

My wife received email that administrative processing is complete and to submit her passport, yellow form, copy of email and envelope. We submitted the information on Friday afternoon. We have still not received her passport. How long it takes from the date of submission. Does this email means that her passport will be H-1B stamped and there would no more questions.

As I understand University of Massachusetts is quite good , though not Harvard, and they offer complete online MBA. So is University of Nebraska, University of South Dakota, North Eastern University, University of Colorado ... all of these are AACSB Accredited .

Another option (just to confuse you more).
Technically it is possible that your wife alone can go for H4 stamping, you enter using AP, your wife enter using H4, and you continue working in H1 maintain H1 status and your wife maintain H4 status.

I have a similar question to ask. Sundeep, I apologize if I hijacked this thread.
If my LTV (Loan to Value) is more than 80% during the refinance, do I have to pay PMI? Can someone confirm this? Are there any lenders in market who can refi without PMI? Is there any way to avoid PMI in this scenario?
It depends. In the good old days you could bypass the PMI by getting what is called the 80-20 loan. The 80 was the first mortgage and the 20 was the second mortgage (for the so called equity - which is a joke). The 20% part (or second mortgage) usually has a higher interest rate (this could be either a fixed interest rate - called a HE Loan or it could be with variable interest rate - called a HE Line of Credit).
Nowadays, very few lenders give this kind of a loan. I myself went for the 80 - 20 loan thinking that I did not have to pay PMI. In retrospect - might have been better to do the 3% down and paid the PMI. This is because the PMI is usually 1 - 2% of your payment (depends on how much you put down initially), while the 2nd mortgage is 3 - 3.5 % higher than the first mortgage (atleast for me that is how it was). Also, the PMI will stop once you build 20% equity - which can be in as little as 2 years. However, the 2nd mortgage (again - the one I have) is for 15 years - after which it will balloon. So, in retrospect, I think I got screwed as I will be paying more in interest now that if I went for the PMI option.

ok..finally I got my interview letter for Aug25th.
Note: Calling USCIS helps..it was just a coincidence, that today morning I was able to get to Level-2 customer service and she told m that our interviews are scheduled for aug25th..and noon we got letters.. :D
One important thing is, our PD is mentioned incorrectly on interview notices.
Both PD and RD is Aug 8th, 2007, which is infact my RD.
My PD is Dec 2005.
Has anyone in the same boat or does it matter during the interview for approval?
That is waht I call luck...Cp filer I guess. But how come many 04 Cp filers are waiting and you got it...Thats USCIS my friends....someone picks up ur application and u r in business...
BTW_ how did calling help...u got the letter same day u called..so everything was done already...OR is there a super fedex (teleporter) service USCIS uses if you call them to deliver the letter to you in 2 hrs...

My I-485 was approved on 12/01/2010 and I have received the Welcome/Approval Notice as well. I have however not received my Green Card. Yesterday I was surprised to see an email from USCIS indicating that the online status of my case has changed to "RFE". Upon examining the Approval Notice I noticed that the PD has been misprinted - 07/01/2007 (not current for my EB Category) instead of 07/01/2005 although I am not sure if it has anything to do with the RFE?
My attorneys suggests that I need not worry about the PD misprint on the Approval Notice and that we need to wait till we receive further communication from USCIS regarding the RFE. I came across this link that however indicates that the misprint on the approval notice might cause the National Visa Center (State Department) to not issue a visa (Refer: National Visa Center (http://travel.state.gov/visa/immigrants/types/types_1309.html))
I have a trip planned to India in Jan.
*** I am wondering what this RFE AFTER an I-485 APPROVAL means? Is it just an intermediate state till they fix the approval letter, OR is it some additional info they need that they forgot to check before approving the application :confused: OR is it an erronous online status that I need not worry abt?
** I am wondering what the best course of action is? Is "wait and watch" the best thing to do or should I call USCIS to inform them abt the mistake on the Approval Notice? My dates for the India trip are quite tight because of a family emergency.
*** I am not sure what happens to my Green Card? Would they have stopped the card production?
I havent come across a similar scenario in the online forums. Please let me know what my situation mean and if I might still be able to avoid postponing my trip to India

I thought of entering through AP, but 1140 is not approved and have about more than 4 and half years left on h1b. so it is tricky sitution. I am hoping they approve my visa in couple of weeks or i am thinking of using AP. what is your opinion.

Why is an amendment required if you are using portability? And if an amendment is required anyway, what is the advantage of using portability - cant I just amend my H1 and be done?

If you plan to stay on H1 with your employer and you move to a different location , then new LCA & amendment is needed. Amendment has nothing to do with AC21 or EAD or 485.
