I understand it is legal. Well, what if ex-employer responds to the query asking NOT TO GIVE THE GC to its ex-employee? With this there are 2 answers to USCIS query - one from ex-employer other from principal applicant. USCIS query is directed to the ex-employer and there is all the possibility that it gives more importance to ex-employer's reply. We are kind of jeopardizing getting GC here. Educating the implementor of a rule about the same rule is ridiculous but that is the world we are currently in!!! shame on US CIS!!!!
The basic push I was giving was that he has to tell USCIS that he has used AC21. If ex-employee gives "don't give GC", that has no effect if you have followed the rule of the law of AC21. You need to explain and write indetail. Nobody can do anything if you followed law. Lot of application are pending, lot of similiar names and the chances that these type of issues do come up are more.

my friend filed on 2/10/2011, he got the AP documents yesterday, 68 days, (online status still says "Initial Review"), he applied "paper filing" , not electronic at Texas, looks like electronic filing is taking time than "paper filing"
my case:
Filing method: Electronic
Receipt Date: 2/7/2011
Status: waiting
number of days past: 72 days

They are not going to kill H1b program at any cost. Basically if their real intention is hire H1b when there is unavailablity of skill then that will be beneficial to them.US citizens job also protected and also 1 h1b person creates 4 new jobs(That's what Pro immigration community says). Whatever restrictions they will put companies will find a way to bring H1b persons unless outright ban is done. But I beleive expansion of H1b program beyond 85k is impossible for a few years. That also was resolved by L1. Basically immigration is going to be as usual for next few years.

for EB2 China/India, the number for calender Year 2006 is "0". and the foot note reads "Categories not listed are "current"...
does this mean we are entering 2007 for EB2 as some predicted.

There are 23,205 pending applications for the year 2006 (as the column is titled "prior to"). So if the SOFAD numbers are going to be in the range of 23,205, then entire EB2 for 2006 will be cleared.
Going by the numbers being estimated by some of the esteemed members in the other thread, 23,205 SOFAD might be in the range of possibility, but I am not raising my hopes.

Another important point is Humanitarian consideration.
Maybe we cannot argue for new H1s, but people currently in the country should be allowed to continue here.
Many of the H1Bs here have made long term plans here. Paid taxes all these years, contributed to social security and medicare ( maybe quote the amount) though they are not eligible to receive these benefits as non-immigrants.
Forcing these people with years of experience in US to leave US will make them valuable assets for companies competing for american jobs from outside US.
Many of the successful companies in US were founded by Immigrants. With these talented professionals forced out of the country, they will impair American competitiveness.

One of my friend, he came here last DEC 2005 from India through Atlanta based consulting company. My friend paid for his H1, he paid for Air ticket to come here. The company never gives any support to find his project...

Beautiful. That paragraph that starts with "Just be aware.." is pure garbage. Note that applicant after applicant tells the federal courts that they contacted their congressperson for help, not once has the FBI or anyone else said that intervention by a congressperson will increase the delay. It is an outrageous statement. All you are asking is for the Congressman to inquire about the status of your name check.
Write back to the aide and ask:
"Are you saying that an inquiry from my congressman about the status of my name check is going to further delay my name check? I want to make sure I understand this, because if true, this would be contrary to FBI and USCIS testimony before the federal courts and Congress.
Please clarify if this is indeed the case, since this matter would undoubtedly be of interest to the entire community of applicants who are stuck in the name check process, the USCIS Ombudsman, and the House Subcommittee on Immigration."
Please save the original email -- print to pdf and send it to
(1) your attorney
(2) the USCIS Ombudsman
(3) House Immigration Subcommittee Zoe Lofgren (who has been grilling USCIS about its various dubious practices and is a former immigration attorney)
to let them know that even congressional aides are misinformed about
(a) the name check process
(b) the role (and consequences) of Congress in helping those who are left without recourse in this matter.
Not sure who has fabricated this myth -- the aide who is sick of making inquiries on behalf of constituents or the FBI which wants Congress off its back.
I will say frankly that congressional inquiries do not result in the FBI expediting the name check; however for those who do not know when their name check was initiated, a congressional inquiry can produce that basic basic information.
However, for a mandamus lawsuit you need to establish that you tried every other alternative before coming before the court. Petitioning for help from Congress is one of those alternatives.

It happened in India to my friends wife, when she was trying to get her H4 visa stamped. Her fingers does not have any traces of line marks, just plain. She has to see the doctor to fix it. Also she has to visit the Consulate for 3 times, because of that problem.
