Did any one get their GCs WITHOUT getting the CPO email? I got PDA emails Sep 11 (saying that they have approved the I485 applications), followed by SLUDs Sep 13. I didn't get any CPO email or other notification. Should I expect the CPO emails and THEN the GCs, or just simply the GCs?
As I read through forums, I understand that there is no consistency in those sequence of online updates.
You may receive your cards without getting the CPO.
There is a chance that, your fingerprints might not be refreshed so you may be requested for FP - if such a thing happens, you will be notified.
I am under the impression that it is just a system glitch.

Hi,
One of my friend is working in L1 on Informatica tool for one of the financial client.
Does it mean that his company is violationg rules?
His company is harrassing much for some personal reason and asking him to come back home country
what action he can take against his company if his company viaolating L1 rules.
Please anyone come across this situation then give us your suggestion.

He can not take any action. If they ask him to go back he has to go back. If informatica is embedded in another s/w which is company copyright then there is no technical violation of L1. Also if the project is administered by his company there is no violation of L1. If it is staff augmentation case, which does not seem to be the case here, then it could be violation of l1.

since a lot of people are debating on this issue and a lot are researching on it ( i know atleast 2 people are actively researching on this topic :D). Does any one know how can i find the status of my PD porting. My lawyer sent the request in June after 3-4 days a say LUD on my 485/140/EAD/AP. I filed my 485 on July 2nd 2007 with a ND of August 17 2007. My EB3 PD is oct 2003 and my EB2 PD is July 2006. Do you guys think the LUD was because USCIS has Ported/interfiled my PD, Is there a chance for the Green in next 2 months?
I think the people who are trying to file the Lawsuit must be the most knowledegable people about this issue, Can you guys provide some +ve response for a change.:D

We are in the middle of a fight to get recognised of our problems and for sure the director responded to our non-violent protest.
What we do next will count.
Should we lay down our arms a surrender now? This will be a sign of weakness. Lets fight on.
Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.

I think we are getting noticed. With Ombudsman's office also, we initially got a very generic response - but now we are getting more specific response and asking us to provide more info. With USCIS officials it might take a bit longer but we need to keep sending letters and they will realize the issue.
They may not have any malicious intent but if this practise is not brought to their immediate attention it can become more prevalent. Rules surrounding AC21 are confusing and they never got into rule making process. By raising this current issue - we might even get lucky in convincing USCIS to speed up the rule making process of AC21.
If you havnt yet sent letters - please do send them.
My letters are also on the way. I sent 4 letters by USPS as mentioned in first post on this thread.

I think the division of Eb2 and EB3 will be over when oct VB comes. Mostly Eb3 will go back 2003 or 2004 and Eb3 date may be 2002. At that time there will be unity.
The current visa bulletin says EB3 PDs may go back to the level that was in June 08 visa bulletin or worser. So it is very likely that EB3 will be anywhere between Apr 2001 to Nov 2001. Personally I would be happy if it remained at least beyond May 2001.
I dont see EB3 moving to 2002 unless USCIS wants to agressively move it forward, so that they can continue their unfair trend of procesing some out of order low hanging fruit cases in EB3 category, just because they are sitting on the top of their applications pile, even if they had much later PDs. Just like they are doing with EB2
What will unite people is to fight against the common pain point... *Unfair advantage given to out of order applicants* , whether it be EB2 or EB3, who are much later in the queue, but some how are on the top of application piles, and easily accessible to IOs- who are making DOS move the PDs, just so that they can clear of their tables by approving these cases, rather than trying to access applications in FIFO and follow a fair process.
The whole EB2-EB3 divide arose out of this unfair practice of USCIS. Which just on their whim move PDs forward , be it EB3 or EB2. It just happened, that EB2 date has been moved more aggressively, probably because there is less backlog there. But looking at all the EB2 people still waiting with 2003, 2004 PDs while 2006 are getting approvals, indicates that the real problem is USCIS not doing due diligence to identify the right cases to be processed next and get the exact count of such cases.
Just asking them to recapture visa numbers or cyring foul against wasted numbers etc will still not solve the problem unless we also FORCE them to follow FIFO and process cases FAIRLY. And do their due diligence to spend some time and put their application piles in proper order. Otherwise USCIS will continue to use these recaptured visas and use them to approve FU***&G Out of Order cases and manipulate & play the system to achieve that by jumping around the PD up/down/'U' and what not, just so because it is *convenient* for them to do so.

Get over with it bunch of whiny losers. Someone can can and is willing to do the job cheaper than you.
Think from your client's perspective:
1. Why should he pay you more if he can get someone for cheaper price?
2. Are you willing to do the same job for the salary that is offered by TCS, WIPRO?
3. If you screw up , who is responsible? What can you do to mitigate damage? TCS/WIPRO can replace the whole team at free of cost to make project successful.
4. YOU guys want to leave companies at will but the companies should not replace you at will?
If you were bringing in value to the client that they cant get from TCS/WIPRO then you will have the job. Get some more skills, be best in the business and be smart. Know what it takes for long term success. You have to be on your toes all the time.

Yesterday, their bouquets of purple roses, pink lilies and yellow daisies, which cost about $40 each and which were sent from all over the country, piled up on the immigration office's loading dock at 20 Massachusetts Ave. NW, addressed to Gonzalez and stacked in columns taller than people.

Then, on the day of the deadline, the State Department retracted the bulletin. The USCIS, which processes the applications, said it had already met its 140,000-person annual quota for employee sponsored applicants.
Those who tried to apply were told they had to wait. Some new applications may be considered again starting Oct. 1, but others may have to wait for years. The wait has become even longer after a surge in green card applications, amplified by a provision in 2001 that allowed undocumented immigrants or immigrants who had overstayed their visas to apply for green cards. The problem was exacerbated by the increased FBI security checks required after the attacks on Sept. 11, 2001.

Shyam Bindingnavale had spent years of anguish in pursuit of permanent residency, so when the government offered him an opportunity to apply for it and then abruptly snatched it away, he was furious and deeply disappointed.
Bindingnavale, 36, a Gaithersburg resident and financial analyst working here on an H1B visa for skilled technical workers, struck back the most effective way he could imagine: He sent flowers to Emilio Gonzalez, the director of the U.S. Citizenship and Immigration Services. So did about 200 other green card applicants, most of them professionals, natives of India and working legally in this country.

They did it because that's what Gandhi would have done.
Yesterday, their bouquets of purple roses, pink lilies and yellow daisies, which cost about $40 each and which were sent from all over the country, piled up on the immigration office's loading dock at 20 Massachusetts Ave. NW, addressed to Gonzalez and stacked in columns taller than people.
The agency forwarded them to soldiers recovering at Walter Reed Army Medical Center.
"We know the reason behind it and understand the symbolism. We donated them in the same spirit in which they were provided to us," said an agency official who spoke on condition of anonymity because of a lawsuit over the matter filed by an advocacy group.
The idea for the protest began with the Indian immigration community on the online forum Immigration Voice, a site devoted to issues facing skilled, legal workers seeking permanent residence in the United States. Hi Guys,
I sent the flowers on the address suggested bu some links on some websites but USCIS is not accepting if exact suite number is not mentioned on the address. I called their office and asked for the addtress for Emilio Gonzalez but they did not give suite#. But they mentioned that he is on 5th Floor.

Let's give them one more month. I just hope that if they are using LIFO now (latest application received being entered into the system), they should also use LIFO in processing the cases, meaning the last case entered (probably an early July filer) will be the first one to be processed.....just a wishful thinking.

I think you can go ahead to the HR and just ask for a letter stating that your position xxxx is still available for you and that you are paid xxxx. If not, you may receive a RFE for the letter. I have seen some people not getting a RFE for letters if they attached most recent pay stubs showing they are paid prevailing wage.

though you are processing through consular processing, can you please verify if you have any reasons ( birth country, spouse birth country) etc.. To get charged against a category that is current now. If so, it is business as usual, else not sure.. You just got lucky your case is approved, but again .. With pre-adjudication, etc.. We never know.. Anything requested from uscis, do respond in time.... on the other hand makes me wonder, if the eb2 dates can really advance that much ???? Significant forward movement based on other thread... Anyway good luck.

But the best part of the interview for non-fans like us who regularly point out Lou's non-obsession with the facts, was an exchange with Stahl where she notes that in the course of a story on illegal immigrant carrying diseases into the US, Dobbs minion Christine Romans says there were 7,000 cases of leprosy in the US in the past 3 years. Says Stahl, "60 Minutes checked that and found a report issued by the U.S. Department of Health and Human Services, saying that 7,000 is the number of leprosy cases over the last 30 years, not the past three. The report also says that nobody knows how many of those cases involve illegal immigrants." (Emphasis ours). This exchange then ensues:
"We went to try and check that number, 7,000. We can't...," Stahl says.
"Well, I can tell you this. If we reported it, it's a fact," Dobbs replies.
"You can't tell me that. You did report it," Stahl says.
"I just did," Dobbs says.
"How can you guarantee that to me?" Stahl asks.
Says Dobbs, "Because I'm the managing editor. And that's the way we do business. We don't make up numbers, Lesley."
Wow. Let's let the arrogance linger in the air just a bit, shall we...?
But that's not all. In the end of the interview, there's this back and forth on whether Lou is a journalist, which of course everyone knows he's not. Imagine an interview with a guy claiming he's Elvis. Same-same:
STAHL: I'm sitting here saying to myself, `This man runs a news show?'
Mr. DOBBS: Hmm. I do.
STAHL: And you can just tell me you don't like the president. Whoo.
Mr. DOBBS: I, matter of fact, insist that the audience know where I come from.

I just mailed my letter to the President, CC-ed Senators from my state, Congresswoman from my district and of course, IV. I also attached my past correspondance with the lawmakers to the letter, so they know that this has been an on-going struggle from the grassroot level.
