You are correct in your assumption. As long as you get your GC by 10/1/2008, you don't have anything to worry about. Key is to get it approved by then.

I am about to file I-140 (PP) and I-485 concurrently beginning of June.
But looks like the the May 21st cut-off screws it up completely.
I have heard someone say that I might escape the new law if I get a Green Card before the law is enenforced on (10/1/2008). Does this assumption even hold any ground? Doesn't the proposed bill say that anyone who has filed I-140 after May 21st 2007 has to reapply regardless of where he is in the process.
Gurus please advice.

I had emailed Houston consulate 3 times and every time got a reply saying No ATV required. I had a printout of the emails with me, incase they asked me about ATV. If they would still not allow me, there was nothing that I could do other than rescheduling the travel and going to Chennai for a ATV.
Looks like your backup plan will fail?

Some of you say, why bother about these folks who will not change. But, I have noticed that these folks do what they are doing because they think what they do is right. So nothing wrong in poking at these folks.
Sure, its just that I think its more effective to "poke" your friends/colleagues instead of anonymous posters on a forum.

I don't have a NRE/NRO/or any other bank account in India. I'm planning to send money this year via Citi Quick Remit service to my parents as a pay back of the loan. If I exceed 10K limit, do I still need to report? Technically, I'm not going to earn any interest on this money.
Again...Whether you get any interest or any income on the money you send to India doesn;t matter..If you have any sort of account on your name and if it is in excess of $10K at ANY GIVEN TIME, then you need to report to IRS...

I belive the data received by IV may be correct, however I believe the spillover assumptions made are incorrect. IV has underestimated the spillover and have not considered the current recession and lower GC application. This will change the scenario in the next 6 months for EB2, but EB3 will be a concern, which will need the CIR or recapture to bring some reasonable movement.

Thanks everyone for all the responses. Now I have got some clarity (ofcourse the answers from each counsular region are contradictary, but I assumed the worst, i.e we need ATV when on AP)

1. Me & my wife (on AP) and my son who is a citizen are scheduled to travel next week.
2. Based on the info at this URL, I'm good for travel from US to India. I'll take this print out.
German Missions in the United States - Transit Visa Country List (http://www.germany.info/Vertretung/usa/en/04__Legal/02__Directory__Services/01__Visa/__Transit__Country__List__Visa.html)
3. I have a Business Visa for UK good for 10 years. So I'm thinking I'm covered as indicated by this URL http://www.new-delhi.diplo.de/Vertretung/newdelhi/en/01/Visa__Requirements/DD__Airport__Transit__A,property=Daten.pdf for travel back to US.
Excerpt from above URL: An Airport Transit Visa is not required for holders of valid visa issued by Bulgaria, Romania, Cyprus, Ireland, United Kingdom, Canada, Japan or
the USA irrespective of the travel destination.
Since my son is a citizen of US he is covered as well.
4. Coming to my wife I have the following options in the below order of preference
A) Apply for US Visa, she still holds 4 months of H1B validity on I 797 - currently no appointments available
B) Apply for Transit Visa at German Consulate in India - Hope they will accept AP to grant Transit Visa
C) Re-route the itenary via middle east to US thus skipping Germany - Not sure how difficult this would be with lufthansa

andy_garcia, the measures in 2238 are draconian. They are going to treat each employer like h1 dependant employer. The salary requirements are increased. Sub contracting is out. No company with more than 50 employees can employ more than 50% H1bs. The job will have to be advertised first. All this makes it as difficult a procedure to follow as obtaining a green card itself.
For giving green card, I can understand that the government make strict rules, but for giving out H1Bs, why is the govt acting like commies? Shouldnt the companies be able to decide whom to hire, and whom not to?I agree with some provisions of 2238 such as - not giving job preference to h1b or advertising that the job is available only to h1bs

Friends,
my company's lawyer will be swamped with new I-485 applications, since everyone eligible is already sending applications.
I am in the process of preparing 2 packets so that if he delays I can file by myself before retrogression hits again.
Now, my question is: Can I attach a courtesy copy of already approved I-140 when filing I-485? Also I do not have A#!!! I guess that is not all that important, since when my I-140 was processed there was retrogression.
Word of caution for everyone: On June 16th USCIS published new memo overriding Yates memo, basically saying that they will have a descretionally right to either issue RFE with less than 120 days for response and/ or deny and reject cases where initial evidence is missing. So, carefully prepare all your applications...check all docs and files, money orders, filing fees, etc etc...
I filed my AOS at the beginning of May and included a copy of the I140 approval notice. My A# was on my approval notice fortunately. I carefully put my packet of application together according to my employers instructions so this memo is not much use to me right now. However, am hopeful it all works out since we have already had fingerprints done within a month of application. I believe that if they simply deny all applications if initial evidence is missing, however, that chaos would ensue and they would be bombarded with appeals. Not good for anyone involved.
