question 1) If a position requires an MS degree, then a BS w/5 yrs 'progressive' expreience may be considered as equivalent. Is the converse true? If the job position requires a BS w/5yrs 'progressive' experience, is a MS considered equivalent?? It does sound simple, but i havnt seen it stated anywhere that the two are reciprocal!!
question 2) Can the part time research assistant experience gained during masters degree be used to for the EB-2 eligibility

It depends on how the LC is filed. If a position requires an MS degree, it does not imply automatically that BS w/5 yrs is acceptable. When filing for LC, there are columns (not sure of the exact numbers) in the LC form that ask for minimum education required and minimum experience required AND alternate education and alternate experience accepted. So if only minimum edu. + minimum exp. is filled in the LC and the alternate edu. + alternate exp. is left blank - then the only acceptable education and experience is what is in the "minimum" column. A lot of people who have B.Sc. (3 yrs)+ M.Sc. (2 yrs) go this route. The only columns filled are minimum edu. (Masters) + minimum exp. (whatever is valid). Also, if BS + 5 yrs exp. is alternate then make sure that min. edu. + min. exp. is MS + 0yrs (refer to this thread on immigration forum: the person had BS + 5yrs as alternate and MS + 3 yrs as min.http://boards.immigration.com/showpost.php?p=1455659&postcount=2403).
As far as using part time research assistant position to fulfil 5 yrs experience is concerned, YES YOU CAN USE IT. I was able to use 2 yrs of part-time experience as research assistant (after BS degree) to show 15 months of full time experience. The letter from my prof. stated that I worked 20 hrs a week from date1 to date2 and date3 to date4 and 40 hrs a week from date5 to date6 and date7 to date8. The 20 hrs/ wk was when school was in session and the 40 hrs per week was for summer (yes - in summer you are allowed to work full time). So I had 18 months of part time exp. and 6 months of full time exp.

there is no published deadline. As stated in the Visa bulletin, there is a high probability that the dates may retrogress.

As per Section 403(b)(7) of Frist's Bill (http://thomas.loc.gov/cgi-bin/query/z?c109:S.2454:), what is left over in EB-2 and EB-3 flows down to EB-5. Given the huge demand for EB-5, it will definitely use up it's quota and the left overs from EB-2/EB-3. So there will be nothing left to carry forward to the next year.
(5) OTHER WORKERS- Visas shall be made available, in a number not to exceed 30 percent of such worldwide level, plus any visa numbers not required for the classes specified in paragraphs (1) through (4), to qualified immigrants who are capable, at the time of petitioning for classification under this paragraph, of performing unskilled labor that is not of a temporary or seasonal nature, for which qualified workers are determined to be unavailable in the United States.

Ah - another generalization, I didn't realize all H1Bs worked in IT, sorry! None of my H1B friends do.
Getting off topic though, yes, the system needs an overhaul, but this is not the way to do it. There are many MANY people who know nothing of, or have ever been exposed to a few bad apples in the mash potato

I still didn't get one answer though. Maybe somebody from the California chapter can answer this. Is it true that in california most of the H1b extensions beyond 6 yrs for consulting companies are getting rejected, saying that you cannot sub-contract on H1. Does it mean that it has already started? Can anybody throw some light or prove the validity of this statement.
Sorry to stretch on this issue so much but even though I am consultant, I have an offer from my client to directly join them. Now, I will probably make more money as a consultant, but these days the way the lawmakers in this country are juggling with immigration issue, it seems it is lot safer to accept a perm position. Even though lot of my freinds disagree with this saying that this can never become law, as a lot of big US companies depend on short term high skilled labour to get their work done from time to time. Some say even if senate passes the house will not pass the bill etc etc....

H1B is technically supposed to be for highly skilled workers, when a match to the job requirements is not found in the US. In the context of "must hire h1b" as this clause relates to
a) Would a company not hire some one and do not get the job done?
b) Is the cost so prohibitive (increase of 2250) that an employer cannot make any money if they pay the additional fee? In other words, is the employer not making enough money on a H1B to pay the fee? If so, hiring a H1B may not even be worth it.
Alternately, if on the face of it, increased fee encourages employers to find more "domestic" people who match the job specifications, and the intent of the bill is to precisely encourage such behavior what's wrong with it?
It appears to me that anything that is seemingly encourage to hire more "domestic" workers is automatically seen as anti-immigrant, anti-business, etc etc.

If you are the only earning member in the family, you are still eligible up to $ 600 for spouse and $ 300 for each child if your income is less than $150K. Why should a legal resident be penalized for not having an SSN?
The package is still not approved in the senate... that is another matter.

My husband and I were out of the city for few days, and when we came back we knew that our mails were returning back to senders from usps (postal service). We guess that my approved EAD and my husband EAD renewal-application- receipt were return back to USCIS as unclaimed.
Please suggest what I should do for
Case1: EAD renew - online status says � �we mailed you a notice that we have approved this I765�� The EAD has been return back as unclaimed.
Case2: My husband has applied for the EAD renewal - the receipt has been return back.

I edited my previous post since I had missed the gist of your question. But here is the additional information pasted again.
From the point of recruitment to application, it took about 3 months. I hope it is faster for you. Make sure you get all your previous jobs experience letters at the soonest. That's what took me a long time otherwise the time period from recruitment to application would have been 2 months i.e. approximately 8 weeks.

Yes, after filing 485, they will send the biometric appt ASAP in a month or two. So, it is better to be here in US for atlease 3 months to complete all these things.
Sorry for this pestering attitude :) but I have to be in India in the last week of August only for a week - so what would be a good time to file for 485 to make sure my travel is smooth?

I was really afraid to ask this question as people here don't like different type of question, then also i thought to take a chance.
If you are a working couple with kids, you know the value of having a maid here.
So I am planning to get a maid from india.
Can she apply for b1 visa (with sponsorship letter from me).
Can I specify the actual reason(help with child care) for visa or I just have to mention "visiting purpose"??
I am fine with her traveling to india every 6 months.
I came here on H1 and working on EAD(dependent with 485 pending).

It is really hard after living in one country for 12-15 years ...(punctuated by about six 1-month visits to the home country) and ..........then to start all over in another country ...even if it is where one grew up as a kid and as a young adult.
