guys after seeing such a long thread i gave some credibility to the post and called USCIS... after jumping through several loops and CS agents ... none of whom had any idea regarding the development mentioned in the post. So after insisting to talk to a senior person I was transferred to ... what they call head of information and CS rel or wat ever it is... i dont remember it exactly... anyway.. i explained our situation/concern/paranoia to him... he listened carefully and gave me these following reply...
1) USCIS is working diligently to process the receipts, but since USCIS is handicapped by limited resources compared to the huge wave of applications it will take some time to post the receipts. In his words "we understand your agony but you also have to understand that we cannot work like machine and solve this in couple of days... we are putting our best efforts and pulling all our resources we very seriously handling the situation"...
2) When told abt the rejection news ... he said he dont have any such information and "we in US gov agency dont play the carrot and stick game... we will honor every word of the july 17th bulletin"
3) when asked what will happen as the visa nos are not available ... he told me "rest assured in USCIS has devised a plan that will take care of majority of the concerns ... but it is unwise to ask anything about the plan as USCIS is in no liberty to divulge any further information about it"...
4) at the end he said not to go berserk at every rumor at every blogs ... "we are all very reasonable people even in USCIS and DOL and understand the gravity of current situation " .... "very govt is tied with some level of bureaucracy so some delay is unavoidable but we are working at our peak efficiency to minimize that"...
5) jokingly he also added that his neighbor is an indian guy and her daughter playes with their kid ... he said "my daughter will kill me if her friends need to go back to india for this"...

After seeing all of your dates I can feel your pain. I am so sorry.
I think USA law makers should think about points system (like Canada) and who is working in the country ( for every year they should add some points) should give preference...etc...

My employer filed another labor via PERM for EB-2 category by changing my current position and the labor is approved couple of weeks ago and my attorney applied for 140 (PP) and 485 concurrently based on my previously approved EB3 I-140 PD. My attorney received the RFE today regarding the 3 years Engineering degree.
Just now I spoke with a Trustforte evaluator, I sent them the copy of the RFE letter and all my academic transcripts. They analyzed my transcripts and agreed to do an expanded evaluation by a professor for $295 (one day rush service) that indicates 3 years Engineering degree is equivalent to US 4 years Bachelors degree. I am keeping my fingers crossed, will keep you guys posted for any more updates.

Come to think....What needs to be challenged in the court is not this but the income tax collection by MI...In that one needs to bring this interpretation of AG and show the court that if AG does not consider us residents then he can not collect taxes from us either. In one shot AG will change his interpretation which can then be applied to Automotive license issue. I think its about time IV take this fight to courts.... Peaceful demonstrations have its place and I believe in Gandhigiri too, but until and unless we strike where it hurt the most (money) nobody is going to give a rat's a** about us. As someone mentioned that host of other states are moving to implement similar restrictions, time to stop this is now....If we loose this battle then it will create echo all over the country

It gets hard to intoduce bills just alone for EB based GC.It would be impossible to get somthing specifically for EB3 India or china. I know the frustation but we have to be pragmatic too.
I'm obviously NOT a core member, so I do NOT speak for IV.
However, it is clear that for several years now, any bill which alleviates the situation in any way is tough to pass, and needs absolutely everyone to pitch in. In this situation, it is wishful thinking that a campaign for any bill which targets a specific section of the legal immigrant community will ever be introduced, let alone pass.
In any case, IV's goals are more broad based, and the attempt is to improve the situation for Everyone, EB1 to EB3. I'm EB3-I, priority date early 2003 myself, so I can fully understand the frustration, but we have to deal with the facts and proceed pragmatically.
Tearing ourselves apart with sub-agendas and narrowly focussed campaigns is NOT going to help!!

Do you have any specific idea in mind? All these days IV efforts were independent of EB category. But you are right most benefits will have to first satisfy all upper categories before trickling into EB3 Ind / Chi.
I have a question for IV core group. Is there something IV is planning to do to help the EB3-I cause? Before you answer, please read the bullets below

Krish9 - I mailed my AP application to the Phoenix location as well around April 15th, I haven't heard back (no receipt yet) and my check has not been deposited either. When did your application reach Phoenix and when was your check deposited?
Since it has been more than 4 weeks now - just wondering what is going on. Since your timeline is very similar to mine, it will be very helpful to get some more info from you.

Remember that the 25000 is the "on paper" salary, not the real one.
To explain: When I came to the US, my former employer once came with a proposal whereby I would get a very low salary on paper, and the rest via " reimbursements of expenses" or some such thing. There were other variations too, like low on paper salary with percentage of billing rates, entirely fake on paper with actual based on billing, various complicated arrangements for "on-bench" time, etc etc.
I jumped ship and joined an American company which was at least on the up and up when it came to salary and expenses.
But the larger point is true: The H1 system has been throughly abused by consulting companies, and the result is that everyone suffers. (Except the proprietor of the consulting company - most tend to be owned by a single person)

Here is the part the math doesn't make sense to me, I ran the tool with IV data and I have 4639 people ahead of me in GC queue (my Priority date is Mar-06 EB2 India), and when I run the tool with USCIS data, it says correctly ~ 21953 folks ahead of me. Looking at the USCIS published data on there site (which is posted August 25th 2009, and probably doesn't include the recent approvals), there are approximately 7000 EB2-I cases pending till January 2005, which is where the visa bulletin cut-off date is. Assuming all 7000 cleared in September 09 and IV data is the most recent, there should be at least ~15000 ahead of me!
I do not understand how the 10000 or so 2005 folks are missing form the IV data, when they were never current between USCIS published data and IV procured data.
Can someone shed some light? :confused:
