forget about MI law i have no idea of how insurance companies would provide insurance and above all its used for any other transactions.

We must try to get this provision in the bill.
I would also say "10 years in the US, have W2s, one should be eligible for Citizenship". Forget about he applied for GC or not, or how many times he got screwed up from the employer, as it happens.
And similarly for 5 years, a GC can be given, if you prove you were legal... W2.. etc..

It is showing 88 EB-3 INDIA pending application which has PD 2008. The EB3-India (or EB3 in general) wasn't current after July 2007 then what are these applications?
The same applies to EB3-ROW.
Any ideas?
Most likely, these are dependent applications with the primary applicant being current and the dependent having multiple 485s (for e.g. a spouse filing his/her own 485 under EB-3 but also being a dependent on say an EB-1/2 application...)
Or the other explanation could be that these are mis-filed 485s (although technically they should have been rejected and not entered in this queue at all)
But definitely a valid question...

This is a bad argument esp with lawmakers. The very fact that the measure (amnesty) was passed in the congress shows the support for such an effort. By raising an argument against it esp with lawmakers will hurt us badly. I do understand that the filers after 2000 are suffering becoz of this.
The only argument we can make is about the long wait we are enduring and how the recapture or other provisions can help us.
BTW those 290k are not illegals now, they are now in the legal queue. Calling them illegals will surely infuriate the lawmakers.
We probably need some help from IV core in regards to political and legal issues in going forward with this idea. Based on the implications, we can first decide whether to go forward with this and then finalize what we want to ask for.
When this bill was passed, I am assuming that the congress was a republican congress since the president was from democratic party. Is that correct?

* Congress has only little more than a week left before its scheduled recess and with the death of CIR, the Republican Congress has been busy to pass highly election politics charged border security only and enforcement only legislative bills before the recess. The House has already passed so-called Voter ID bill by 228:196 and the Senate voted the Border Fence bill by 94:0 which has already been passed by the House. This latter bill is expected to pass the Senate next Monday.
* Republican strategists intend to add these bills to the DHS Appropriation Bill which must be passed by the Congress. There is also ongoing movement to add legal immigration bills to the Appropriation Bill. The Republican strategists has reportedly obtained the President's coimmitment to sign the bills once these bills are passed, but such strategies are strongly opposed by the immigration interest groups including AILA and there is a massive lobbying to block such legislation. The Republican strategists also face unexpected internal opposition to such strategy by Senate Appropriations Committee Chairman Thad Cochran (R-Mass) who reportedly stated that he would not add any legislaive language onto the spending bills that could slow their progress in the final days before the coming recess.

I would like to know about the Salary that is mentioned in the letter from the employer - is it the current salary or, the salary mentioned in the labor?
My thought is if the employer says: "..at least <salaray from labor>.." it should be ok.

I just spoke to a NICE IO (really nice one who really took the time and was not pissed off at all the questions i asked).
Per him, the RD is what they go by. every month on the 1st when the lot is to be assigned to the IO they go by PD to see who all became current and then order them by RD in the ascending order (atleast this is what he told me).
Then I asked him, is it not unfair for people like me from 2004 are at a disadvantage compared to 2006. For that he empathized with me and he said that they do not have any control over that and it is the DOS and he also mentioned about a few more callers from 2004 who called him and expressed the same concern.
Also it seems like there is a little bit of overlap coming from the month end. If some one is processing some applications from last month and he happens to have some leftovers from last month he would still process them even though they are not in order potentially causing some more discrepencies and that there is nothing they can do about it.
over all it was a good conversation even though i know the pundits on this forum may disagree with him as much as i do, but i hope there is some truth to this and hopefully there is some order than no order.

the number of pending applications for EB3 India in April 2001 are 451 and the cut off date in the bulletin is 22 April 01. But in the case of Mexico, the number of pending applications in the same month is 2106 with a cut off date of 01 June 02? How is that possible?
