Thanks IV for all the effort behind this.
But this tool is very misleading. It doesn't take into account all the EB2 approvals in September, which I understand it won't be possible to factor in till the new numbers come out.
But it can definitely do better with the spillover estimate. This is broken for sure.

BTW, the tool with the open data from USCIS says I will get approval in May 2013 with spillover, and Dec 2013 without spillover. Haven't tried the 'FOIA based data' tool again as no point in using that.

I am really enjoying this discussion..its been a while since I have been in the minority expressing my viewpoint.

keep in mind again the basic point of this debate H4s with ITIN will not get rebate, I have no problems with H4s with SSN getting the rebate
1. ur right about circumstances changing. but circumstances change over a period of time. I was again reffering back to your point of spouses traumatized about not being able to work and I was just pointing out a very commonplace example of people not "following their dreams" (thats what many of these spouses claim) when push comes to shove. If you are that traumatized then at least work on a part time basis when you have the opportunity.
2. as I said before this is about taxes, not immigrant rights. I am totally with IVs goal of H4s working like L2s..when u say "is one thing to get unfair treatment from the system n the government and another to hear an opinion like yours from a fellow immigrant," it implied that as a immigrant I am not allowed to have a separate opinion in terms of tax rebates, from the rest of the immigrant community. That is uncalled for and also leads to herd mentality, where you are either with us or against us.
Yabadaba, i have NO issues againt your point about people who dont work get no tax rebates. AS LONG AS IT APPLIES TO CITIZENS AND IMMIGRANTS ALIKE. If it does not, then contrary to what you may believe, it IS an issue of immigrant rights and not about taxes anymore.
About immigrant right, yes it HAS TO BE a herd mentality. Remember United we stand, Divided we fall. So yes, we HAVE to stand together all legal immigrants alike.
Now about your point regarding SSN v/s ITIN Remember one thing:
1) Not all H4s that get an EAD and an SSN will work.
2) Not all H4s have been able to apply in the July 2nd rush inspite of being stuck for several years due to attorney goof-ups, labour certification problems, I-140 issues and various other factors.
3) Not all H4s are eligible for applying for H1Bs as not all jobs are conducive to H1Bs
4) Because of the H1B shortage, not everyone that applies for an H1 gets it.
So in short, just coz someone has an SSN does not mean that they have worked hence paid taxes. The other point here is that you CANNOT fault an immigrant for not paying taxes if they are NOT allowed to work by the LAWS of the nation
If you still think that this issue is not one of immigrant rights, then more power to you.

Hi Everyone,
Just wanted to updated you all. I got the Recovery Rebate tax credit for 2008 filing even for my H4 dependant child. I filed my taxes online with a status of Filing Jointly with my Spouse. Both my spouse and I have SSNs as we have our EADs (status being Adjustment of Status- filed I-485-awaiting approval) but my qualifying child does not have SSN as he is still on H4. I added his name using his ITIN and got back the following Rebates:
$600 (my spouse - have SSN) + $600 (myself - have SSN) + $300 (my child - has only ITIN) = $1500.00 amount deposited on April 3rd 2009.
Please calculate your Recovery Rebate Credit by going to the IRS 2008 Recovery Rebate Credit Calculator.

I am not disputing the fact the forum is used to post issues. But check who are all asking the accountability...? People who never donated a dime. How can they expect and question accountability for others money. First they will have to give and ask what happened to their money and how it was spend.
I dont want a non-donor come and ask how my donation was spend....
I'll offer 2 other perspectives to look at this
say you did not contribute or did not even vote for the politician who represents your district....do you still demand accountability? why? cause that politician is representing you... whether you like it or not
IV represents a common cause whether the GC seekers like it or not so it should not surprise you when they ask for accountability
As a second perspective
Say you are an investor and a hedge fun manager comes to you with a great investment in a company. Do you blindly trust what the hedge fund manager does with your money or do you want details about the investment and the company?
Nothing wrong with seeking information about the organization you want to invest in
Rather than being mad/frustrated you should be happy about a prospective interested investor!!

Again, I hope you are right. I have read those Stein report remarks. They are not nice, of course. But the people like Cornyn who say nice things about us just don't seem to have been able to get their bills passed. Anyways, since the core has not responded still, it probably means they don't think this is feasible.
Cornyn did deliver last May..S 2611 contained every thing we wanted...He cannot do anything about the house holding up the bill for 7 months....We have to find someone in the house.....

People waiting to file their I-485 also need some kind of relief.

I am also on the same boat. Mine is 3 years Engg Diploma + 3 Years B.Tech+ M.Tech(Computers) and all are from India. I have 8 years of IT experience and working for well known company. My attorney is saying that my case can not be filed under EB2 because I don't have 4 years Bachelor's degree. Even I have Masters Degree it can not be equated to US Masters degree unless I have 4 years Bachelor's degree. I have tried to explain her that mine is actually 4 Years Bachelor's Engg Gegree, but I completed in 3 years because I was admitted directly into 2 year of my Bachelor's Engineering as I have 3 years Engg Diploma. But no use, she still says not possible .Here is my attorney response ..
"Please note that recent guidance suggests that USCIS will not accept an application for the EB-2 category where the beneficiary has a combination of degrees to show the equivalent of a US Master�s degree. Although your evaluation does indicate that your education is the equivalent of a US Master�s degree, if your Bachelor�s degree was a 3-year program, you may not be eligible to apply in the EB-2 category"
I was shocked after hearing that, I don't know what to do now. Please share your thoughts.

That basically leaves people whose spouses came directly on H4 in the last few months and/or people who did not apply for 485 in july.
Why do think those who missed the boat in July are not worthy to recieve tax rebates. May be that you are lucky that your wife managed to get H1 even before you filed 485 but that does not mean other H4 spouses do not try or don't want to work. I know my wife tried but she managed to get job only after EAD and now she has an excellent job.
Also not everyone was lucky to file 485 in july. I personally know a friend who is not new to this country and he could not file because desi employer refused at the last minute. His wife is CPA and just could not get a job due to H4 status.

In example 1, the applicant does not extend his H1B status even though he hasn't filed his I-485 yet. So the gap between his H1B expiry and I-485 filing is unlawful. We know that already. on Jan 2, 2009 he neither has a valid H1 extension nor an I-485 pending. So he is unlawful.

My apologies for posting this question here as this is related to Air France. In 2004, I had to take a transit visa since my Air France flight was via Paris and am wondering if this has changed. I have an AP and will be using that to re-enter US. Anybody has any recent experience to share?
