To my surprise, they have proposed that anyone who proves worhy for the US economy, in the initial 3 year period of the H1B, automatically granted their Green Card. For me this seems to the best proposal ever for reforming the H1Bs.

Well, the situation in the STEM area is dire indeed. Very few US citizens are entering the field and majority of graduate programs in the US are run with a majority of foreign students. A large number of these students had to go back after their 1 year OPT and the rest went in for another graduate program to wait out for the next year's H1B quota. Most industries are now screaming that they can not find enough engineers and scientists. On the other hand other western countries with skilled immigration programs are going to make a killing. So the SKILL bill and other such legislative measures will be out of dire need for the US rather than a lobby pressurizing congress. As far as retrogression goes, it may not be a high priority - the way congress looks at it, well these people (who have filed 485) are in the US, working - they just have to wait out for their visa numbers. I don't think the majority of Americans or congress understands the 485 process including the ability/inability to file 485 due to retrogression. Stories of those who ran out of the 6 year H1B limit needs to brought out to highlight the plight of these people.

My wife's case was being reviewed by the Adjudicator due to error on part of USCIS in making a decision. The online status has just changed to post decision activity indicating
" We reopened this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on November 16, 2010, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you"
Is it safe to assume that the case is approved? Any predictions on how long USCIS may take to get the EAD card?

you do not pay it back but when you file your taxes for the year 2008..which would be in 2009 they would deduct the amount you get as a rebate thru the stimulus package!!

I have a couple of Indian grocery stores in my area where I will put the posters.
A good idea would be to put a colored one on the wall and put a bunch of black & white ones that people can take with them. Hopefully, they will look at the one they took along and finally visit the website.

Could be. I guess, we are all so desperate about the reciept number and EAD and AP, that we would be the only people calling for a "Reciept Number".
But it is hard to believe that what she says may not happen.

It is a good draft overall. Removal of per country cap for EB, non capped GC for STEM masters degree holders, Recapture of lost visas. All of these should help clear the backlog. Also the commission only provides reports to congress every year with recommendations and the congress will vote to increase or decrease the numbers. Also, the spouses and children of LPRs will be considered immediate relatives thus uniting them sooner reducing delay.
Increased border security, biometric social security cards should decrease future flow of illegal immigrants. The two phase approach to those already present in the country illegally will ease them into society slowly and helps to avoid anti-immigrants' stand that this is amnesty for votes. They will not be eligible to vote for at least another 13 years (8 + 5). This is a more humane and better approach to dealing with those already present here.
Overall, this is a good draft that caters to all the current issues of a broken system and should find approval from most except the hard core racists and xenophobes. Let's push to get this enacted soon to make this a reality.

Retrogression and delays are driven by quotas and not by prejudices of USCIS employees.
They are there to do their jobs just like everyone else. They dont slow down their work or act with prejudice against any country's immigrants or their cases.
There is a procedure to adjudicate cases and they follow those procedures and even if they want, they cannot just start acting on whim to reject cases. They are underfunded and overloaded and that causes slowness. And the USCIS does try, though not very successfully, to reform the system : Recent example: BiSpecialization etc. Doest always work but their job is to do their job and not set policy.
This is another tactic of numbersusa to find dirt on USCIS and to use that dirt to trash the entire system of immigration. They want to say that since someone killed while driving drunk, we should prohibit all drinking and all driving.
Please dont be scared of concerned with such dirty tactics of numbersusa. It doesnt mean anything.

I cannot stick to one place as I need to move to places where ever I get the project.
You can transfer some credits from a school to the school that issues the diploma. This depends on the school/deptt that issues the diploma and varies from school/deptt to school/deptt.
You may be able to take courses that are pre-requisite for your MS admission at each of your stops. This can help you in admission to a better school. You will have to make a list of these courses.
I always advise to get the best education, It is an investment for the rest of your life. You realize its benefits only after you get it.

It is my opinion that more exposure of IV and cause will mean more people being aware of the legal immigration system and more lawmakers will be aware of how important skilled immigrants are. They will also be aware that there is an organized effort for attention. Currently we hear in the media sometimes that skilled immigrants are taking away US jobs. Infact skilled immigrants contribute much more to the economy(refer SJC testimony of top economists). Media attention will also bring in more IV members and more contributions. Every year there are 65+ thousand skilled workers getting H1B visas and IV currently has only 4 thousand members. I personally think that there is lot of scope for membership drive and awareness campaign.
