a person on h4 can have a ssn (Social Security Number) under the following conditions
1. EAD holder (that means I-485 was filed)
2. Previous H1 (working) now H4 (not working)
3. Previous F1 (student) undergrad or grad -> used cpt or opt to work -> now H4 holder
4. Previous L2 now H4 (L2s can get EAD, thereby SSN)
That basically leaves people whose spouses came directly on H4 in the last few months and/or people who did not apply for 485 in july.
So what about children who are here for the past ten years and on h4 , paying lots of money for their education through their dads pocket?

Administrator please close this thread its just creating panic attack in people esp around something which is not true. GCard_Dream just came up with a date. My lawyer (Fragoman) confirmed there is no way USCIS or anybody will enforce a date of May 21st( the day bill was introduced).
To the rest of the folks reading this thread DO NOT PANIC PLEASE.This is a fake date.
If that May 21 is a cut off date, then I beleive it will be first time in history that a bill becomes effective on the date of introduction. It's not even law yet. But it's always better to not waste a single day in my opinion. Since I sent in my I140 I will have more than 365 days if I need to do my 10th yr extension.

I filed my EB I-485/I-765 on July 27. I have no receipts, checks have not been cashed. I called NCS on October 27 (90 days after), they asked me to call them in two weeks, which means tomorrow.

I am going through this topic and i relaized you maybe of some help to me. Any help will be greatly appreciated.
I filed my EAD Renewal back in June 23rd and since then my application is in 'Initial Review'. I have done everything possible in my hands to expediate the process but it hasnt helped me in any way. I have done 3 info pass appointment, Opened SR, Letter to Ombudsman (he also replied saying no response from USCIS) and now i contacted my senator for which USICS finally came back saying within 30 days he should get response. My EAD already expired and soon my driving license is also going expire and i will totally stranded. Its alomost 120 days and my case is still pending.
Any suggestion what else can i do to get this moving?

Sorry to hear your situation. If there is a concerted effort from someone in the IV community, i am more than willing to be a part of it.
For now, i will try calling my local senators and explain/highlight this problem.
PS: I think this is a much better use of our time than trying to guess the next bulletin dates.

Everybody please stop scaring others and bashing desi body shoppers. Body shopping IS a business and people of both(white n brown) races do that, Iam also working with a desi employer but just go and look out how many people on h1 are working with these businesses and where else can we work with all kind of nonsense restrictions on h1 like a slaved labour. Rule says the moment your employer terminates your job you are out of status and have to leave the country immedietly,now tell me what happens when you take a full time job and have this kind of situation with a family to maintain and dont even get me started with the whole GC process mess. I definetely agree desi employers (not all) suck blood but tell me isnt he also taking risk by keeping us on bench and allowing us to be there and tries his best to maintain/show us in status. Just put a poll on how many people from this forum are working with desi employers and be surprised. Iam working there by choice(though i had fte offer becz of above said reasons)

When someone says pledge, it doesn't mean that they haven't contributed before or will not contribute now. If the pledge is met (1000 people * $120/person), we will have 120K for our cause, so don't discourage people from pledging.

You make several wild sweeping assumptions here. One, the fact that we came here looking for opportunity so many years ago means that the "opportunity" will be available for a lifetime. That is blatantly false - It is like saying everyone loves to stay in a 5 star hotel; therefore everyone wants to stay FOREVER in a 5 star hotel.
Second, you must be totally ignorant of current affairs to say that returning to India is an exception, not a rule. The list of Indian american citizens who returned to India is a virtual who's who list - almost every week I read a story about some big shot Indian american returning to India to settle down there, including VCs like Vani Kola, pharmaceutical R&D big names etc. And these are in reputed publications like WSJ, NYT etc, not some mom and pop desi magazine. Why did they return ? Certainly not because of immigration reasons. I doubt for sentimental reasons either - they returned for OPPORTUNITY. Yes, the very same opportunity for which they left the mother country. Like they say, the only thing constant in this world is change - thats even more true in this globalized world. It helps to keep an open mind and be on the lookout for opportunities everywhere.
Returning or not is a personal decision based on personal circumstances and opportunity - we don't have to make sweeping generalizations to justify our decision. Just state your reasons and leave it at that.
Very first think comes to my mind is why are you guys coming to US if you feel India is better. Have you seen anyone from US going to India and taking up jobs. Again dont get me some exceptions from here and there.
1. US is lot better than India. Only thing lacking here is our culture / parents/ siblings which are invaluable.
2. World economy is dependent on US economy and it will be the case for next 100 years. So you are better off here.
3. You all guys talk these crap since you do not have GC. Imagine, there was not VISA problem here in US and everyone here gets GC in 6months easily, do you think our peers in this forum would be saying that they are ready to go back to India/home country. I DONT THINK SO.
Everyone wants to be here whether he accepts it or not. Only the frustration with getting GC makes him/her think in 100 different options. But the reality never changes. Every tom dick and harry from every nook and corner of the world wants to come to US because this is the land of oppourtunity and luxury.

My wife had to do her FP againg on Jan 26 2008 after our first FP in Spetember on the second FP notice request USCIS stated the reasond as FBI is unable to process the clearance check card so she had to take the FP againg..after that no updates and LUD's...dose this implies that my name check is cleared in first shot and my wife's not?
can any one had to redo the FP for same reason? please share.
I have a relative whose fp was done twice. If for some reason the prints are not clear, you are asked to give fps again. Even after second fp, the prints are not clear (poor ridges, cuts, etc.), then they will call for interview. My relative was asked to submit police clearance certificates from the places lived. Then only they approved my relative's gc...

Did you try other tool (based on USCIS data).You may get saying you will be adjudicated in 2012 or 2013.As I said earlier something wrong.
1.IV calculator may be wrong ie IV interpreting & analysis of data could be wrong
2.Data itself wrong whch is most probable reason.
Since only few people has access to FOIA data (I donot have access ) those people(speciall IV core people) should compare USCIS public data and FOIA data.Hope they must have done and every one knew both data never match.means some thing wrong.Only IV core team should take action (may be legally) against USCIS for providing false FOIA data.

This almost seems like a tit for tat. Sen. Durbin introduced his and Grassleys ammendments as soon as Sen Cornyn did his.
We all have to admit that there has been abuse in the H1b program. That said there is some room for improvement in their (Durbin/Grassley) ammendment and that is where we should focus. If we do so then we can live with the rest of it. Some of the parts of it are actually not that bad and actually a few help us by putting a more firm responsibility on the employer.
They are really out to get the outsourcers here. In all honesty, it is in the US interest that they do so, it is just that they might kill the consulting industry while they are at it. We need to suggest an alternative.
The other thing is that, if there is less outsourcing and consulting then there will be more full time jobs as well, since the manpower is nevertheless required.
Of course the real carrot for us all is that if Sen. Cornyns provisions stand, then green card delays will be mostly administrative/bureaucratic and not visa number shortage. Nearly everyone will benefit from it.
This might be a trade off we need to support. This will be no small victory.

I have actually been here since 1999 also. Anyway I think we all here mostly want the visa numbers increased one way or the others. Few of us here care what happens to the H1b quota. Clearly the H1b visa issue is more radioactive than the visa numbers issue. However our lobby is small compared to the big players in this ie Tech/Healthcare Industry on one side and Anti Immigrant groups on the other. If I had to throw my weight into one corner, I feel we are likely to get more comfort from the former than the latter. The latter would screw us no matter what!
Of course educating the lawmakers about our plight and gaining their sympathy so that our issue is addressed whichever way the winds blow is great and for which reason Shilpa and IV's involvement is such a godsend for us.
The industrial lobby is very strong, and it would be foolish to underestimate them. All I was saying is that it is possible for the non-industrial lobby (e.g., AILA and IV) to get laws passed. That has happened before, and that is our only hope here. The tech industry lobby will try to get more H1Bs, and probably forget about us.
