45 day letter was sent by DOL on 3/7/06.
Lawyer received it on 3/14/06.
Lawyer sent the notice to my HR on 4/10/06 (after sitting on it for almost a month....am VERY upset with the lawyer...but, that is another story...HR is following up with the Lawyer on their delay).
HR responded to the Lawyer on 4/10/06.
HR is also following up with the lawyer to ensure it gets sent out ASAP as the deadline is 4/21/06
Question: How do they determine that the response has been received in a timely manner? Is it based on mail receipt, or them actually entering the data to continue with the case before 45 days are up?

But one of the main required document to get even ATV is to have an valid US visa in your PP. Do you have one in your PP? If we had that then why we would even need their crap ATV?
Another option for you would be to apply for ATV in India when you are there. That is what I am going to do. It is about Rs. 4000 per person, but worth the peace of mind. Next time I am traveling either non-stop or through pacific route. No more through Europe

The reason is simple.
Did this current CIR topic come with the president's apetiite. NO. It came UP as one of the impo topics of discussion because of AZ reason. Right. And with the same setting, I'm sure this bill will get more focus.
And I think I read even TX wants to implement what AZ did. Other states may also follow, why not. AZ started it, and there is unemployment everywhere and the illegal flow is not stopping. I'd want it in my state.
Hence the CIR may come up as a forced situation and must be done with no other option to delay. I hope it passes also.

Anyone who stayed more than 183 days in 2008 here in US, must declare all their accounts in home country or any other country, if at any time, the cumulative value in those accounts exceeded $10,000. IRS extended the declaration deadline to September 23, 2009.

2) If they are not available leave a VM for them -

As you may already know that this is a bi-partisan bill with wide bipartisan support in the house and will help improve American competitiveness & reduce the back logs associated with USCIS. Hi there,
I personally seen two of my friends H1 (extension) got denied.
They both work for different desi companies, have been working ever since they are here in US. Have all the documents up to date required by USCIS...yet they got denied....
One friend's denial was because his education did not match his work...although he did his Engg in Comp. Sci. and working as an programmer analyst.
The other friend is awaiting for the reason...he came to know only couple of days ago, and he is literally in shock.
I dont know whats going on???!!!:(

I don't blame USCIS at all. The desi companies (either bodyshoppers or big IT companies) abuses the system, therfore USCIS tightening it now. H1B and L1 has lot of conditions (LCA, worklocation etc..). Most of them not aware of it.
Though people do get caught in between this mess. Desi bodyshops that abuse the system are the major threat to Indian prosperity in this country. They should be shut down and owners of these sweat shops should do time not in Gitmo but somewhere close to rocky mountains CO. Not all desi companies are in this category but they have to suffer due to these cockroaches.

Hey relax all legal immigrants, this was brought up simply to STOP illegal immigrants being issued a DL. What they say is any one who is not a resident of Michigan will not be issued a DL, and illegal immigrants would NOT be considered residents of Michigan, thats all what it is about. How on earth can they say no one having a work visa and legally in the US would not be allowed to drive?

how about we align ourselves with them? :) I would only ask te reduce the 3 year requirement to 2 years.

Main reason for h-1b denials is that within the law; a company can be an employer (working at their location and under their direction and control) or a staffing company who is outsourcing the employee to another company.
Right now; uscis especially vermont service center is believing that the majority of companies are into staffing. Therefore; they will not accept an internal project (if you try to submit one; they ask for a lot of information; including letters from clients or potential clients) who have purchased the product.
If you give a purchase order from another staffing company they will deny because it is not with the end client.
if you get a P.O. without enough detail of the job; they will deny stating the duties aren't specific enough that a degree is needed for the job.
