I thought as per the new memo it is advisable to extend your non-immigrant status even if you have filed your AOS and work on EAD.
I know many people who were on H4 and started working as soon as they filed AOS and got EAD's, now in this case there I-94 issued for H4 is still valid.
When their spouse extended their H1B's, they did also extend the H4 petition to get new I-94's.
Like the attorney mentioned, you can't maintain H4 and AOS status at the same time. You can file for H1 to H4 COS but as soon as you use your EAD and start working, you will lose your H4 status. Having a valid H4 I-94 does not mean you still maintain H4 status. You can't work on H4, period. EAD gives you authorization to work based on your pending I-485, but then using your EAD will put you back in AOS pending/Parolee status. Hope this helps...

I applied for my 7th year H1-B extension in March (Mat 14th) and received a WAC case number. As per the USCIS case search, It was approved last week. But I have not yet seen any confirmation from my attorney.

Many people here believe that if a person on H4 has an approved H-1B w/ COS from Oct 1, and that person does not really work starting from Oct 1, then he/she falls out-of-status. In our case, my wife is on H4 currently and I am on H-1B, and both of us have AOS/EAD pending.
Now, if she works for 1 month and decides to take a break, and stay home on EAD, is she still out-of-status?
I must be missing something here; because I was under the impression that if a person (derivative, and not primary applicant) has EAD, then it does not matter if he/she works or not. Chandu: I disagree with you. I think nobody complained on the website itself. People were unhappy with what it showed. The case status is incomplete and very abstract. I do not think anybody cared about navigation or buttons. Besides, it really they listened to the complaints, they would have fixed many more things before this thing. This would have been the last piece to do especially if they are having lack of workforce.

They tell this to everybody. A very common answer. They told me so, so to my 2 other friends but in either cases, no GC was approved inspite of our PDs were current. And later it turned out that my name check is pending (don't know what is 180 rule mean) when I took Infopass.
So don't believe those CS answering over the phone. They say name check is clear when it is not clear, they say I-485 processing date is 2006, April when processing date is 2007, April 28. Bunch of junkies or may be summer interns (all called I made around summer time).
To be CS in USCIS the only qualification you need is to be an US Citizen with back ground check cleared and a high school diploma :-(.
How a person can understand with the above qualification all those difficult stuff like PD, RD, AP, EAD, LC, 485, 140 !!!
And some CS even referring my I-485 application as I-40 :-( repeatedly.
They may have to answer so many other complicated cases in Family category as well. Like what happen when spouse gets divorced? Can one file dependent GC if he/she is gay? Some one got married one US citizen after crossing the broader illegally, can she/he get GC? Can a son/daughter from stepmother apply for GC? So don't blame them either.

He in fact found my A# as i only had receipt number handy. He than told me that the FBI checks are cleared and my case is assigned to an IO.
Does case assigned to an IO means that when Visa nos are available i have chance to get GC? Does it mean it is adjudicated and waiting for visa NO?

No need to be scared of CIR. Even CIR is passed in current form US will reward right people those who are ready to take challenges. Make note of people who came for study in 1970 to 1995 How did they survive and overcome lot of issues. Those who want to get greencard on arrival has to forget and pack the bags. Check with the employer and the designated lawyer if they received a notice saying 140 denied.If not check with your employer and see how the trend is wrt 140 approvals recently if anyone got approvals or any denials if yes is it an Ability to pay or Education.Either way you can file a Motion to reopen for both 140 and 485.I believe it has to be done in 30 days. So you should really rush getting this done.I would advise doing it from a very experienced lawyer than the actual lawyer who filed your original cae.

My friends recently went to the consulte in Nogales to get their H1B stamped and they told me that we can enter Nogales with out any visa ... You might want to explore that or find any other places that are closer to where u live and do not need a visa to get a new I94 ...

Unless you're feeling seriously hampered by your set of lenses right now, and you're planning on spending some dollars on new lenses, I'd stick with what you have at the moment, and only upgrade when you actually see a need to do so, rather than "better do it before it's too late".
Yes, if you have advanced plans on buying more lenses, then I would consider upgrading the camera as well - before you have such a huge collection that you can't feasibly afford to change brands.
I would also very seriously consider the fact that Canon has undeniably the best select of lenses, and most people (except some Nikon fanatics) would probably also agree that the Canon lenses are optically better than the Nikon equivalents [although there are many factors here, some of which are based on personal experience, some are probably depending on whether you get a "good copy" or "bad copy", etc, etc].
Flash memory (SD or CF) isn't very expensive these days, so unless you have several gigabytes of it, you probably need not really worry about that so much when it comes to choosing your next generation camera.
I have to admit, however, that the Nikon D80 has a very tempting price and feature combination. I'm sure it's a really good camera.
Finally, although I'm somewhat of a Canon fan, my latest camera purchase was a Nikon - a small Coolpix 7600 so that me and my wife can carry an unobtrusive camera when need be. Carrying a EOS 10D around is a little bit more noticable...
