lots and lots and lots of h-1b's getting denied. extensions, change of employer, 140's approved, etc. doesn't matter.
just about all h-1b's getting rfe's and many, many are stuck in "background check". This is just a cop out by uscis where they are investigating companies use of h-1b's (this is reason for slowdown in processing times ) by vermont service center.
uscis caught many companies in fraud - also consulates - many companies giving internal projects, etc. or fake purchase orders and getting caught by department of state which then forwards to U.S.
ICE is making visits to consultants homes to verify where they are actually working and comparing to h-1b's.
Next; investigations will start with greencards.
I warned last year; that all the noise everyone was making about h-1b's and greencards was going to eventually get hit back by government agencies. Now; we are seeing this.

As per this, IV need to distribute among the community irrespective of donor or not. Else we can again file FOIA request with USCIS and ask for the info and tell that IV didn't distribute it to all.

Example 1 does not contradict Example 2
In example 1, the applicant does not extend his H1B status even though he hasn't filed his I-485 yet. So the gap between his H1B expiry and I-485 filing is unlawful. We know that already. on Jan 2, 2009 he neither has a valid H1 extension nor an I-485 pending. So he is unlawful.
I agree with your decipherment of examples.

It is taking a lot longer than the last couple of years. I filed mine end of June, normally TSC would have approved it by now. Unfortunately this time it was transferred to the evil NSC and I am still awaiting an approval.

Anybody has any doc + cost in the Las Vegas area?
I did it today. No appointment needed. Bloodwork+Vaccinations+exam+paperwork+Tb skin test = $160.. for child $60
address is 3375 pepper lane, Pecos and E sunset next to USCIS office.
Now the place is a little cheesy, so expect it to be like an RTO office as in India. or more like DMV as in US. :-)
If I need an xray that would be extra $50. so worse situation $210.

You missed another group - J2's who have worked and have SSN and have converted to H4 and so cannot work but still retain the SSN.
Any way I have been in this country for 12 years - still on H1 and my spouse is on H4 (no EAD etc.). Luckily my spouse has an SSN as I was a J1 student. I was wondering whether my spouse would deserve a share of the refund if I were originally on an F1 and my spouse would only have got an ITIN instead of an SSN.
What's your thought on a case such as the above?
Just one point regarding this whole debate - The philosophy of most taxation system (including that of the US) is to provide some measure of equalization between the rich and poor. So if income tax is filed jointly the income is treated as a "family income" and there is no distinction between both spouses working and one spouse working. Also a person have 10 children (an extreme example) will get a big exemption. Also income tax laws in any country are designed to tax income irrespective of whether the source of income or the person is illegal under other law (criminal law or immigration law as opposed to tax law). Therefore if everything comes down to a tax rebate everyone should be eligible both as a matter of law as well as a matter of policy.
Therefore the ITIN vs SSN is a red-herring. This ITIN/SSN divide for LEGAL immigrants was created circa 1996. Earlier every H4, F2 etc. was provided with an SSN. Of course illegal immigrants still had to get an ITIN. Therefore as you can see that H4's with ITIN is but collateral damage.
It's good to have an opinion ---it's even better if you can explain your stand with general arguments without too many qualifiers and exceptions.

a person on h4 can have a ssn (Social Security Number) under the following conditions
1. EAD holder (that means I-485 was filed)
2. Previous H1 (working) now H4 (not working)
3. Previous F1 (student) undergrad or grad -> used cpt or opt to work -> now H4 holder
4. Previous L2 now H4 (L2s can get EAD, thereby SSN)
That basically leaves people whose spouses came directly on H4 in the last few months and/or people who did not apply for 485 in july.

Sending mass emails from yahoo etc. may be taken as spam. You may use some site like constantcontact.com to send professionally looking emails. They even allow free email campaign.
