I do not understand why people have to wait for IV to "endorse it"
If you think this is right, just go ahead and send it.
A lot of them are sending the flowers and have not heard/care about the IV or the polls
The idea is to get this message across to the USCIS. The email chains that are circulating is doing this already
If the amount of $30-$40 is too much, at-least send a get-well soon or a sympathy card to the USCIS

It might sound like a crazy idea � but if you are filing for 485 right now (just as most of IV members) you might have seen the rush at the USCIS doctors offices. My doc gave me an appointment at 12; I went there thinking it will be done in one or two hours. Its not � they gave appointment to atleast 20 people at the same time. We were all sitting there for hours to complete tests. I talked to a bunch of people some of them are aware of IV; some of them are not (or atleast they said they are not aware). I asked anyone who is not a member to join us and about the efforts to increase greencard numbers. Of course a few of them looked at me as if I am selling something � but its fine for a good cause.
So if you are going for physical/immunizations for I485, take a few small sized fliers or cards with you. If your doc is same as mine, there would be many people like you waiting there and you can make atleast talk to a few. These are all the directly impacted people and are actively pursuing green card so there is good probability they will join us here.

The crazy ordeal comes to an end... I got my ead today...
Man.. this is the toughest and persistent effort i have taken so far in mylife. after going through this I have decided I will spend atleast an hour every month visiting my congressman office and seek his help on our issues. I encourage each of you to do so. IV has excellent material. We should have our cards by 2012 and its only possible by legislative fixes. we all need to be persistent in letting our lawmakers know our pain... wake up now.

Just to clarify to imv116, I do not have a diploma from NIIT (Not that I think any thing wrong with it). I said, my situation is confused with that situation. I had to go through TWO competitive entrance tests (with almost 100000 taking the test) before getting admission in to these courses and both are granted by reputable GOVT and AICTE accredited institutions.
To your free PHD offer , No thanks. Because I came this far without a PHD, so I guess I can live without a fake one.

Answer to original poster: Your 3 year B.Tech is absolutely eligible for EB2, provided if you have at least studied 4 years in accredited college/polytechnic to receive your terminal B.Tech degree, after 12 years of high school diploma. There is a difference between combination of education and pattern of education. Your�s falls into different pattern of education. So, you are fine. I am one of the classic example successfully got 140 approval from NSC in EB2 after a RFE. Mine also 3 year B.Tech. Do not spend money on education equivalency evaluation. USCIS do not care even if you submit 10 evaluations from different companies, they do not recognize. Fist, edu.evaluation is opinion only. It is not a binding document. Gets a letter from your school explaining the education pattern. It is more efficient. I did the same. They approve my 140 on the same date they reciived my reply.
The entire education equivalency has been screwed up by desi companies, desi workers, education evaluation agency and of course lawyers. USCIS had been very flexible till last 5 or 6 years. Because of substantial abuse, the USCIS had become stricter on the education evaluation. Peoples try to combine any degree (like 3 year b.com and 1 year PG diploma) to arrive at equivalent to 4 year BS in computer science. I have seen a post by one guy got a evaluation saying that his 3 year BSc in geography + 1 year computer course in NIIT/Aptech equal to 4 year BS in Comp.Sc. USCIS is not stupid to accept this is equivalent to 4 years computer science. I am not undermining any degree or school. Because of so much abuse, genuine guys like you and me I got affected. Though I studied in highly reputed schools, I got RFE in 140. It was a big surprise for me. It took tremendous amount of time/money/energy to overcome the RFE, though I graduated from one of the top 10 engineering school in India comparable standard with IITs.

How come no one specially democrats never talk about problems of legal immigrants? As much as I like democrats, they are starting to annoy me by just talking about illegals. On the other hand, repubs only talk about the needs of businesses and have the attitude of never mind the legal folks.
I think we need to work with Green party :). Man.. are we ever stuck. All of a sudeen the multi-party system in India sounds far better political system than the 2 party system in U.S. Let's add that as one of the IV goals to change the political system in the U.S. to be a multi-party system :).

I am going through this topic and i relaized you maybe of some help to me. Any help will be greatly appreciated.
I filed my EAD Renewal back in June 23rd and since then my application is in 'Initial Review'. I have done everything possible in my hands to expediate the process but it hasnt helped me in any way. I have done 3 info pass appointment, Opened SR, Letter to Ombudsman (he also replied saying no response from USCIS) and now i contacted my senator for which USICS finally came back saying within 30 days he should get response. My EAD already expired and soon my driving license is also going expire and i will totally stranded. Its alomost 120 days and my case is still pending.
Any suggestion what else can i do to get this moving?

People may think it's funny because they don't understand the stakes involved. If they truly understand that there may not be another chance for recapture if we miss the CIR bus and they have to wait another 7-12 years then the reality will hit home. Hence, I have taken pains to prepare the intro material on IV ( E-mail to friends) and the Rally (first post). This should help them understand the situation better.

I had a couple of questions about filing for AOS for my wife (I am a US Citizen)...We're filing ourselves but came across a few questions/hurdles that we sought some guidance on...Any help would be greatly appreciated.

I-693
G-325A
I-864
My wife has been studying here in the US regularly on her F1 visa and returns to Switzerland about once a year (Updating her I-94).
First question, we plan to visit Switzerland this summer and we are currently hoping to have our AOS application in before the July 29th deadline for fee raises but will be in overseas during the initial phase of the process...Upon returning to the US, what happens with her F1 visa?...Are there some changes that need to be made?...Her I-94?...Is there something adiditonal we should file since she will be undergoing an AOS?
Second question, in Part 2 of the I-485 form it asks for 'Application Type'...Would our situation warrant selection b) my spouse or parent applied for adjustment of status or h) Other basis of eligibility?...Wording was slightly confusing.

Can some one advise me which data is correct? whether the correct data is FOIA or USCIS website data? :confused:
If USCIS website data is correct, then the EB-2 cutoff date can not be 01/22/2005 and it should be much more earlier

In 2004 I applied again after I had to change employers, by that time I I knew a thing or two about EB categories and applied in EB2, apart from that I did not know anything about GC.
Then perm came and pushed all the existing labor to backlog elimination and the rest is history..
