It would be very good have an ability to apply for I485 for spouse or any other dependents for primary applicants whose PD is retrogressed.

I first applied Green card through the EB3 process and my priority date is March 2003.
Since there is very little progress in EB3 category, i convinced my company to re apply in the EB2 category as i got promoted (Salary increased) so that i can keep my old priority date. They re applied in the EB2 category and i crossed the recruitment stage and waiting for the PERM to get approved. (applied 3 weeks back).
Now i am current in EB3. Now, i am not sure whether i can go forward and file for I-485 under EB3 or wait for my new PERM spproval and apply for i-485 under the new EB2 category.
Please advice.

Oh !! I see then to approve for a 2001/2002/2003 485 case , every month USICS needs to make the VB current on 15 and take back to on 30 ....
Not necessarily that they have to make it current as the retrogression kicked in only @ 2005 Jan, so none with PD 2005 or later has their petition pending at this time at least in EB2/3 category. Also in 2004 there was not PERM and folks filed for Labor, except in certain states like Iowa, etc... Were waiting for labors somewhere between 6-10 months minimum. Mine took more than 2 years. So the I-485 petition pending, latest PD most likely could have PD�s up to June/July 2004 for EB2/3 category. So if they set the cutoff date Dec 2003 or Jan/Jun 2004 they will have sufficient petitions that are already processed and ready for approval, If they do not want to loose the visa numbers. I don�t understand the logic behind the VB, that visa availability showing current for all categories.. Had they bumped the Cut-Off date by 6 months at a time for each month or even a year, this might not have been so bad.

Looks like NSC is also approving I-485's. Not sure how long this trend is going to continue, guess all depends on how much visa numbers gets trickled down from other categories to EB2 India / China. Hope and wish they are many.. which would helps many people waiting in line and PD not getting pushed back for FY '10. I feel bad for EB3 folks though, seems like nothing going to change for them at least in near future, untill there is some congressional action. Hopefully the next VB gives some indication on how things are going to move. Good luck and wishes to all who got greened, especially with older PD's who have been waiting for years. It depends on the service you choose, I think they have an option for expedited service and you can get the document within couple of days. They also provide you the pdf format of the document, you can print that document and submit immediately instead of waiting for the postal document.

dohko, The point of satishku_2000's post was that all companies follow the similar business practices. It doesn't make any difference if it is TCS or IBM, Anderson or Infosys. They are all same bunch of people, just different names. So your repeated rant about "indian companies" is not valid any more. We have someone who worked for IBM for 8 years and got 2 pay checks on bench. So now, lets not squabble without any reason.

These companies have people of all kinds which include "US educated" and direct H1s and their green card applicaitons in various stages. All these people have to start all over again. I feel sorry for these guys.

...only if approved. Guess, luck matter a lot when ur dates are current...as those guys are picking up cases randomly. Majority of approvals thus far are Feb/Jan 06 , when oct/nov guys are still looking forward..Please, dont get me wrong....Systematic approvals helps everyone...as you know the celebration time has come

DO NOT FALL IN LOVE WITH YOUR TRADES Get your profits and move out or cut your losses and move on.
MAKE A PLAN ...STICK TO IT
I will try to answer any questions that anyone may have. I can also give an overview of my trading strategy on my blog posts.

I think it will take almost a month before there is significant number of members who sign up for recurring payments. So, keep it up and spread the word.

We dont really have a month. The work on the bill is happening even now behind the scene. We wish to put in more resources and plan for more resources in the coming months. We are still getting a lot of bounced messages. people have given us email ids like abcd@abcd.com. Well, to such people we say that they will not be hearing any announcements from IV when we send a newsletter with announcements. And sometimes sensitive information will be given by phone or to contributing members only. So all must update their profile with full information and signup for recurring contributions. We may not make sensitive updates public on the forum. This will be an incentive for people to sign up for monthly contributions.

Body shops want you to fake ur resume only when
(1) You want to get your wife a h1b placement through a body shop, who actually has no experience but you approach the body shop for filing ur spouse h1b
(2) You do Master's and want to get a placement through a body shop.
(3) Your skills are not marketable by body shopping requirements.
This part I totally agree because this is what my experience was through out the beginning of this year. I have 6years of experience. I last worked in 2004. So a lot of consulting firms were not willing to sponsor my H1. A few of them asked me to fake my resume to make for the 3 years gap. I did not do that. Finally I got a good desi start up which is doing my H1 at their own expense.
But now I am waiting to win my h1b lottery!!!!!

I made it a point to clarify that these bills support Highly Skilled Based Legal Immigrants waiting patiently in the line for a green card for 5-10 years.

Ok, ok . Once upon a time, when we were planning the San Jose rally, Tamsen & me were discussing that we hand out flowers to passerby because that way, we could weave the concept of "flower campaign" into the San Jose rally.
So, I posted a message with subject line "Flowery campaign"
On the actual day of the rally, after we were all done. Some laggards including Logiclife, Pratik, myself and a few others went to lunch. There Logiclife mentioned that one strange dude (which was me) had posted such a strange sissy message about "flowery" stuff. It seems that Logiclife must have forgotten my ID. He said it so seriously that I didn't have the heart to tell him that it was me. He went on to say that what was this person thinking.
Fast forward to Situation room in Hyatt(09/16), someone suggested the idea of handing out flowers to passerby again. The old wounds were reopened ;-). I thought that this is the time for my pound of flesh. Logiclife, as anticipated opposed the "flowery" idea. I then pointed out that the strange guy who posted the earlier "Flowery idea" at San Jose rally was me ;-). I saw Logiclife turn red. Paskal took the cue and started to close in on the kill and wanted Logiclife to support the idea. That is the story. Other gals picked up onto this and that is how Logiclife got cornered by the "flowery" idea.:o

To be honest i never visit the forum page unless i need to search for something and thats very rare....can we put up a link or an Icon with a tiny banner advertising the free lawyer phone call on the home page?
I am not sure if you are part of the campaign for 'Filing for I-485 when PD is not current'. We have explored all these ideas and even we put flyers all over the Indian restaurants and grocery shops. But not much happened. Even I have personally called people around five - six times and asked people to support. Though they are languishing in the GC line, they couldn�t find any time to visit IV. What would you call a person when he is saying for various reasons not to meet the law maker�s staff in their local office? They are able to find various reasons for not to meet but couldn�t find even a single reason and time to meet once but still questioning others work/ effort. Are they just making fun of us or do they just think they are doing a favor for others?
If one genuinely interested to work on the issues there are various ways to do that. Sitting and complaining about others is not going to help but just irritate others

There are just too many fond memories to share in one post... but I do want to specially thank leo2606 who drove 70 miles to pick up myself, venkygct, vsraja and punjabi at the Dulles airport and then took us out for breakfast, then to the rally venue, then for lunch, finally to a hotel room we had booked for a quick shower, basically... like a shadow he was with us wherever we wanted to go! And... whenever we thanked him (and gdhiren who co-ordinated pickups/dropoffs for many others like the 4 of us) these guys, instead of saying something like "You are welcome", would profusely thank us for flying in!
Its people... like leo2606 and gdhiren.. and many others are the true strength of IV!
abhijitp, You deserve to be the MAN OF THE RALLY (I don't like to argue with ladies so I am choosing MAN :)) Whaever crowd we had at the rally the credit goes to you for the Partner thread which really helped increase the attendance and eventually out of area crowd beat the locals. Unless one has studied in the US, one will not realize the worth of the US educational system. One clear attribute of US educated professionals is their superior written and verbal communication skills. Not to mention the enhanced ability to culturally fit in a diverse environment.
If this were the case why so many "US educated desis" work for so called "body shoppers" and stay in "Guest houses" provided by these desi consulting companies.
