this does not make any sense .. what about dependents who are using EAD ( AOS).... If they renew H4 they loose AOS and then as soon as they use EAD or get paid on existing job the status changes to AOS .. ??

My wife's case was being reviewed by the Adjudicator due to error on part of USCIS in making a decision. The online status has just changed to post decision activity indicating
" We reopened this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on November 16, 2010, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you"
Is it safe to assume that the case is approved? Any predictions on how long USCIS may take to get the EAD card?

It would be nice if there is a provision for faster Citizenship for the people who filed 485 and waiting for GC. (>2 years wait).
May be asking for more?
I second something like this. If in valid status all through and 485 is merely pending due to back log, grant an interim GC.
Also remove the restriction of priority date needing to be current for filing Dependent 485s. (This ties into not counting dependents I suppose).
Any plan from IV for a phone/fax/paper mail campaign?

I was just replying to some one's post calling it unfair that Eb3 2001 is waiting in Eb2 2005 is moving ahed. All I was trying to convey was all these years Eb1 was current ( so well over 6 years lead over Eb2 & 3) but no one cried wolf or unfair all of sudden on Friday Eb2 moves forward and we get these cries of unfair . What does this mean? I agree we need to come up with idea's for Eb3 I but the only one I can think of is visa recapture. If some has better idea that does not put is Eb2 Vs Eb3 then I am all for supporting it.
I would please request not to enter the argument about different categories being current and what is fair and not. There are other threads which are discussing the same.

I agree. Life on EAD/AP is just as if you had a green card - except you can not start your own company. But one can keep changing jobs, promotion etc. The con is that one has to apply for EAD/APs each year meticulously. If the employer is paying then even that is a minor irritant.
But as the saying goes the grass on other side always looks greener. Once you get to file 485 and get benefits of AC-21, one wants the green card, and then one longs for the Citizenship to get over the hassles of keeping documentation at all times. Once one gets citizenship people then forget about others in the queue and soon forget the trials and tribulations they underwent:)

Yabadaba, only if closed mind came with closed mouth, none of us will have any problem. You cannot think outside our own situation. I bet you would be pretty opposed to idea of H4 not receiving tax rebate if your wife was in H4. Secondly, if you dont have kids, you have no right to comment of people who have them. I think if someone is desperate for a job and still decides to sit at home to take care of their kids, we should really respect them for the sacrifice.

Are I-140s also getting denied for consulting reasons? I have an amended I-140 pending (company merger issue). I work for a fairly large consulting firm for the last 8 years and always have been with the same client(fortune 10). My H1B is valid till Nov 2009 and EAD till Sep 2010. I don't intend to extend my H1B at all but I'm worried if this new CIS stance might also apply/affect I-140s. Anyone seen I-140s getting denied for consulting reasons...

Only 140 denials recently are related to ability to pay issues by adding up all I-140's of a company.
I posted earlier of how california service center was denying due to "temporary job".
I had done a lot of research; and apparently uscis doesn't go after 140's usually due to consulting because there is a legally precedent case that uscis has to follow from 1963 or 1965 where a company sued uscis stating that even though they are a temporary staffing company that if they have a permanent job then they should be allowed to sponsor for permanent residency. The company won and uscis usually follows this. California service center was trying to get around this due to saying the company doesn't have a "permanent job".
Any info on this is appreciated....

Why did you have to ammend you tax returns?
to avoid going into issue of showing that excess profits weren't allocated to others..
i was short of 5k in each 4 years,company had already issued me 1099s in prev years that my lawyer never sent before. also, i never properly accounted for 1099s in my tax returns so i had to amend them to include as wages and not as bbusiness income because this time i sent my tax return to USCIS

We must lobby the Governor on this issue. She has expressed interest in both keeping jobs in Michigan and in the Innovation agenda. Repeatedly speaking about attracting IT jobs, Biosciences jobs, and alternative fuel technology etc. None of this is helpful to do that.
She can push the legislation suggested by Terri Lynn Land at the very least.
We must convince her that, targeting legal immigrants this way WILL cause them to leave the State even if not the Country. This will hurt Michigan.
If this rule stands as is, I for one will be moving out within a year. My job prospects are good and frankly this would be too much to take. I suspect I will not be the only one doing so. Michigan's competitiveness will decline substantially.
Michigan in my view can ill afford this. Michigan lost 30K people net last year. Housing is in the slump of slumps, coming in at the top for foreclosures and with price declines averaging the coastal markets, bearing in mind Michigan did not have the run up in home prices in the first place. This would be another nail in the coffin for Michigan's economy.
I do feel she (the governor) is likely to take heed to our concerns. She has been rather quiet during this entire period on this issue.
What do you guys think is the best way to get her attention about this issue?

Not commenting on the whole article, I'd like to comment on the single argument mentioned above. It's a much abused one by anti-immigrants.
Basic Idea: Using the law of demand-and-supply, it's argued that if there were real labor shortage in the country in any field, salaries in that field will simply rise to bring demand and supply in equilibrium.
So what's wrong with the argument: The law of demand and supply is essentially correct and works very well. The trouble is that this is where the story starts, not where it ends. The reality is that salaries find ceilings for a lot of reasons other than the pure demand and supply.
Let's take an example: Go to any supermarket and notice the number of cash registers manned by cashiers vs. the unmanned ones. Supermarkets don't build all the cash registers with the hope of having only a quarter of them occupied with customers lines getting longer and longer.
There's a genuine shortage of cashiers and supermarkets will absolutely love to have twice as many, if not more of them available to hire. Who wouldn't like to go to a supermarket where you don't have to wait 15 minutes in a line even at peak times?
So, what's the problem? Shouldn't it be easy... just increase the salaries...
Well, let's dig deeper. A supermarket hiring new workers at the higher salaries will have to pay that higher salaries to all the cashiers. Supermarkets operate at a typical profit of margin on 2%. A supermarket paying higher salary will simply be uncompetitive. The only practical solution to get as many workers they can get at the prevalent salaries.
Coming back to the context of hi-tech industry, There are a lot of reasons that salaries will not sky-rocket even if there are no workers:
It may make more business sense to simply cancel a project than to get it done at a sky-high labor cost.
The higher is the labor cost, the more attractive is outsourcing.
It may also be more attractive to water down to project to use less labor and keep costs in check than to pay sky-rocketed salaries and make it unprofitable.All these factors impose the limits on salaries and prevent them from sky-rocketing. It's not that employers are evil and don't want to pay a deserving worker; the bottom-line is that it has to make business sense too.

Do we not have anyone from these states? there are some big cities....
I lived in Omaha,NE for about 3 months in the year 2007, and I remember there is a large Indian community over there. It's hard to believe that there is nobody from there to represent NE.:confused:

USCIS advices 7-10 days for a case to be adjudicated but it depends...
Does anyone know how long before the adjudicator takes a final decision? My wife's EAD case, after it was denied because of a USCIS error, is presently being reviewed by an adjudicator. So we were informed yesterday by Ombudsman's office. She has a job offer letter from a company where she has been asked to join on Monday.
Any insights will be greatly appreciated.

I got my skin test done on friday and going to the doctor's place today. If my skin test comes positive(there is some swelling), how long does it take for chest x-ray/results?
